This Act concerns an affidavit witnessing the acquisition by prescription of immovable property. The Act, among other things: sets out conditions for transcription of affidavit; provides with respect to an application for the transcription of an affidavit of prescription; requires the Conservator of Mortgages to enter in a special register the particulars of every affidavit of prescription received for transcription; provides for procedures of transcription including objections by interested parties; defines effects of transcription.

The present Decree enforces the Great Council Ordinance of 5 July on the introduction of a Land Register. Article 1 establishes that the Canton levies fees relating to entries in the Land Register. Notamment, le règlement régit les émoluments requis pour les prestations du service concernant la gestion du cadastre des sites pollués. El presente Decreto Supremo aprueba el Reglamento de la Ley de Comunidades Nativas y de Desarrollo Agrario de la Selva y Ceja de Selva, que reconoce la existencia legal y la personalidad jurídica de las Comunidades Nativas, de la cual son miembros los nacidos en el seno de la misma y aquellos que, habiendo nacido en otras comunidades, residan en ella en forma permanente, así como los que sean incorporados a la Comunidad y que reúnan los requisitos que señale el Estatuto de Comunidades Nativas.

Decree No. 25 of 2013 (IV. 16.) VM of the Ministry of Rural Development laying down detailed rules of land surveying and cartography activity related to real estate registration.

This Decree provides that before supplying data for land surveying activity having real estate registration purpose, the congruency between data contained in the uniform real estate registration database must be verified. If the discrepancy exceeds the allowable measure, the competent land office must proceed with the verification of data. Further provisions contains detailed rules concerning types of schematic maps regarding changes, measuring activity, area calculation, marking the land parcel line, periodical on-site inspections, format of supplied data.

Section VII shall be amended to add the following wording: “In case that cadastre numbers have been defined in accordance with technical cadastre documentation but not assigned until 1 January 2013, they shall be considered assigned and land plots shall be considered registered in State Land Cadastre from the date of submittal of the application by the customer of land survey documentation”.
