These Regulations amend the Planning and Development Regulations 2001 in relation with exempted development provisions of those Regulations. The list of those provisions has been updated and amended. New planning exemptions are being introduced in respect of portable waste disposal compactors, agricultural rainwater harvesting, etc. The exempted development threshold for drainage of wetlands is being reduced.

Le présent décret a pour objet la simplification des formalités à accomplir pour certaines extensions de constructions existantes. Le décret porte de vingt à quarante mètres carrés la surface hors œuvre brute maximale des extensions de constructions existantes, situées dans les zones urbaines des communes couvertes par un plan local d'urbanisme ou un document d'urbanisme en tenant lieu, soumises à la procédure de déclaration préalable. Au-delà de quarante mètres carrés, les extensions en cause donnent lieu à un permis de construire.

These Regulations amend the Planning and Development Regulations 2001 mainly to provide for matters of procedure and administration in relation to Part XA and Part XAB of the Planning and Development Act 2000 (inserted by the Planning and Development(Amendment) Act 2010), which relate to applications for substitute consent and appropriate assessment of proposed development, respectively.

These Regulations amend the Planning and Development Regulations 2001 so as to include the development consisting of the carrying out of drainage and/or reclamation of wetlands in articles 8B and 8C, Class 11 of Schedule 2 of Part 3, and Schedule 5 Part 2.

These Regulations principally amend the Planning and Development Act 2000 for the purpose of giving further effect to Council Directive No. 85/337/EEC and Council Directive 92/43/EEC in relation to proposed development in protected areas established pursuant to Community legislation.

L'article 25 de la loi n° 2010-788 du 12 juillet 2010 portant engagement national pour l'environnement autorise le Gouvernement à légiférer par voie d'ordonnance pour unifier et simplifier la définition des surfaces de plancher prises en compte dans le droit de l'urbanisme.
 La présente ordonnance a donc pour objectif de définir cette nouvelle surface comme étant la surface de plancher close et couverte, sous une hauteur de plafond supérieure à 1,80 mètre.

Le présent décret précise le statut de l'établissement public administratif dénommé « Institut national de l'information géographique et forestière (IGN) » issu de l'intégration de l'Inventaire forestier national au sein de l'Institut géographique national. L'IGN reprend les missions actuelles des deux établissements regroupés avec pour objectif de renforcer les capacités de description du territoire et de l'occupation du sol ainsi que d'inventaire de la ressource forestière.

These Regulations implement provisions of the Physical Planning Ordinance with respect to applications for: (a) a grant of development permission; (b) permission to demolish or develop a building subject to a building preservation order; (c) permission to cut or remove a plant subject to a Plant Preservation Order; and (d) the right to subdivide land. Schedule 1 sets out the forms to be used in respect of the various applications, decisions, requirements and other matters to facilitate the administration of the Ordinance.

These Regulations specify, in the Schedules, permitted development, i.e. development permitted without the requirement to apply for or obtain a grant of development permission. They shall apply to all land in the Islands except, among other things: (a) undeveloped Crown land, other than undeveloped Crown land in respect of which a lease has been granted; (b) land within a conservation area declared under the Physical Planning Ordinance; and (c) land within any declared area under the National Parks Ordinance.

These Regulations concern the administration and decision-making process of the Physical Planning Board established under the Physical Planning Ordinance. The Board shall be responsible, among other things, for the handling of applications for planning permission.
