The present Ordinance implements the Agricultural Adaptation Act in its version of 3 July 1991 (BGBl. I p. 1418), the Land Parcel Act (BGBl. I p. 1091), the Land Lease Contract Act (BGBl. I p. 2075) and the German Land Settlement Act (BGBl. III 2331-1). In particular, the Ordinance lays down provisions relating to the efficient and correction enforcement of the afore-mentioned Federal Acts. The text consists of 8 articles.

This Regional Act aims at preventing the loss of land caused by urbanization and infrastructure growth. The Act aims at ensuring that explotation of land is carried out in a sustainable manner, by preserving the environment and respecting agricultural activities. The Act sets out the principles to be followed by the regional and provincial authorities for mitigating the effects of soil sealing. These objectives are included in the objectives of Regional Act No. 12 of 2005 on town and country planning.

These Rules: amend the Town and Country Planning (Inquiries Procedure) (England) Rules 2000, the Town and Country Planning Appeals (Determination by Inspectors) (Inquiries Procedure) (England) Rules 2000 and the Town and Country Planning (Hearing Procedure) (England) Rules 2000 so that all these Rules apply to advertisement appeals which are to be dealt with by an inquiry or a hearing in England. They also make some other minor amendment to these Rules.

This Decree establishes the modalities of attribution and revocation of the status of particularly sustained territory by the councils for development and territorial planning. The aforesaid status shall be attributed for the period of three years. The aforesaid indices shall be taken into consideration in the process of attribution of the status of particularly sustained territory: (a) local government development index; and (b) territorial land-use planning documentation.

This Order grants, subject to certain conditions, planning permission for certain classes of development under Part 3 of the Planning Act (Northern Ireland) 2011. Conditions are prescribed in part by regulations 55 and 56 of the Conservation (Natural Habitats, etc) Regulations (Northern Ireland) 1995 and for, among others, so-called EIA development, certain waterworks and development to be carried out on land which is within or affects: (i) a conservation area; (ii) a National Park; (iii) a nature reserve; (iv) an area of outstanding natural beauty.

These Regulations make provision for the operation of a new system of local development planning in Northern Ireland as provided for by the Planning Act (Northern Ireland) 2011. They prescribe the form and content of the local development plan (LDP) to be prepared by councils and the procedure to be followed to bring it into effect. The Act (Northern Ireland) 2011 provides for two development plan documents (DPD) the plan strategy and the local policies plan which taken together form the LDP.

These Regulations prescribe the form and content of a statement of community involvement (SCI) as provided for by section 4 of the Planning Act (Northern Ireland) 2011. The SCI shall be prepared by district councils and shall be as prescribed by these Regulations and approved by the Department of the Environment. The SCI shall set out principles of how the council will involve the community in exercising its local development plan functions under Part 2 of the 2011 Act.

These Regulations apply Parts 3, 4 (except chapters 1 and 2 of that Part) and 5 (except sections 157 to 163) of the Planning Act (Northern Ireland) 2011 with modifications to: (a) land in which a council has any interest and in relation to which the council exercises any of the functions of a planning authority, and (b) the development of any land by a council exercising any of the functions of a planning authority in relation to that land, whether the development is by the council alone, or jointly with any other person. The Parts here applied concern planning control and enforcement.

The Act establishes that the right to administer soil, water and air is vested in the State. The State, therefore, has the authority to: (a) regulate the allotment, use, supply and maintenance of soil, water and air; (b) regulate the legal relations between persons and soil, water and air; (c) regulate the legal relations between persons and legal acts concerning soil, water and air. The exploitation of these resources both by individuals or corporate bodies is to be performed within the objective of the national interest and by guaranteeing the protection of economically-weak groups.
