These Regulations make provision for the new development management processes for determining planning applications. In doing so, they put in place the regulatory framework required to implement the development management provisions in Part 3 of the Planning Act (Northern Ireland) 2011. The Regulations, among other things: prescribe the classes of major development and classes of major development that are considered to potentially be developments of regional significance; prescribe the hierarchy of developments; provide with respect to pre-application procedures and schemes of delegation for purposes of the Act (sections 27 and 31). Major development include an “EIA development”, which has the same meaning as in regulation 2 of the Planning (Environmental Impact Assessment) Regulations (Northern Ireland) 2015 and waste management infrastructures including waste water treatment plants.
