There is today a growing awareness of the importance of providing rural populations with more secure tenure to land and other natural resources, not least in Africa where approximately 90 percent of all land is still unregistered. At the same time there has been a rethinking of approaches for securing local tenure rights in practice. Experience has shown that the conventional approach, i.e., individual freehold titling, has often not worked well in areas where communal forms of customary tenure predominate, which is still the case in most parts of rural sub-Saharan Africa.

Land is consistently ranked among the sectors where people most often report having to pay bribes to access services, according to Transparency International’s Global Corruption Barometer. The Land Portal has summarised the latest available (dated 2013) global data here, which shows that the incidence of bribes paid for land services can be over 50% in countries such as Cambodia, India and Pakistan.

The purpose of this paper is to describe and critically examine newer alternative approaches to the securitization of customary land rights in Sub-Saharan Africa with particular emphasis on certain challenges which need to be tackled in order for these to have an inclusive and equitable outcome at the local level. The content of the paper is primarily based on a literature review though the challenges identified with these new approaches are based on observations from the author’s own on-going research on the land tenure reform in Mozambique.

"The Lore Lindu region in Indonesia—as in many forest frontier areas in Southeast Asia—has experienced rapid deforestation due to agricultural expansion in the uplands, at the forest margins. In this article, we examine how improved technologies for paddy rice cultivation in the lowlands have affected agricultural expansion and deforestation in the uplands.

La acción de los grupos armados al margen de la ley ha generado profundas transformaciones en los territorios donde han logrado ejercer su control. En el mundo rural, una de las principales afectaciones especialmente asociada con la acción de los grupos paramilitares, se dio en el abandono y despojo de tierras mediante de diversos mecanismos de violencia y constreñimiento tales como el desplazamiento forzado.

La Ley de Reforma Agraria de octubre de 1973, impuso severas penas a quienes mantenían la tierra explotada o inexplotada fuera del contexto de función social. El Estado aparece así no sólo como el ente que responde a las necesidades campesinas, aquel que sanciona las deficiencias sociales, sino también como aquel que conduce los hilos de las relaciones y no permite que el campesinado haga de la reforma agraria el campo de sus aspiraciones.

Este artículo tiene como objetivo analizar el derecho como un recurso empleado por los actores político-administrativos y sociales estratégicamente y con diversas funciones sociales en las políticas públicas territoriales, tomando como caso de análisis la Política Pública para la Prevención del Desplazamiento Forzado, la Protección, Reconocimiento, Restablecimiento y Reparación de la Población Afectada por el Desplazamiento Forzado en el Municipio de Medellín.
