El objetivo del trabajo es examinar la revisión oficial de las “donaciones condicionadas” implementadas en el partido de Azul y la respuesta de la sociedad rural durante la segunda mitad del siglo XIX. Mediante un análisis principalmente cualitativo de la legislación, prensa, correspondencia, expedientes de tierras y otras fuentes coetáneas, se aborda el marco legal y el accionar social, considerando los argumentos esgrimidos para la puesta en valor de los derechos y el acceso a la propiedad formal.

El artículo muestra cómo la doctrina civil colombiana ha acogido recurrentemente la idea de que los romanos dividieron el derecho de propiedad en tres propiedades o atributos: usus, fructus, y abusus. Luego, el texto pasa a los textos primarios romanos, poniendo en evidencia la ausencia de esa tridivisión entre los jurisconsultos. El análisis continúa con los textos secundarios de derecho romano, resaltando la manera en que las obras colombianas con frecuencia le atribuyen al derecho romano la tridivisión, mientras los textos extranjeros normalmente no lo hacen.

The concept of “property”, usually studied under private law, has suffered internal (the social function as an essential element of the institution) and external (the administrative limitations) changes. As a result of these changes, the concept of property should be studied under the public law´s approach and method. An issue of utmost importance to public law is that it be properly and adequately articulated by the administrative authorities in order to protect the citizens’ rights.

This paper is a report on anthropological fieldwork on the civil society movements in northeastern Thailand. The case of Kok Hin Khao land rights conflicts in the district of Nam Phong of Khon Kaen province was thoroughly examined to understand the current dynamics of civil society in the Northeast.It is argued that the discrepancy between the government's development rhetoric and what actually happened at the grassroots level has laid the ground for the emergence of contemporary civil society to protect its own interests.

Tries to understand the case for redistributive land reforms. Argues that there is relatively persuasive evidence showing that redistributing land may promote equity as well as efficiency. Suggest that it is, nevertheless, unclear, given that all forms of redistribution cost money as well as bureaucratic and political capital, that redistributing land is the best way to redistribute.The second part of the paper takes as given that policymakers want to redistribute land, and discusses strategies for achieving such redistribution.
