The present Act lays down provisions relating to expropriation proceedings. The Act contains at the outset a definition clause relating to various terms employed therein such as, for example, “Board”, “expropriate”, “expropriating authority”, “injurious affection”, “owner”, registered owner”, “tenant”. Section 13 establishes that where land is expropriated, the compensation payable to the owner shall be based upon: a) the market value of the land; b) the damages attributable to disturbance; c) damages for injurious affection; and d) any special difficulties in relocation.

Section 47 establishes that the Nova Scotia Utility and Review Board shall determine any compensation where the parties have not agreed on the amount of compensation.

La présente loi s’applique également à l’indemnisation due en cas de restriction de la propriété équivalant à une expropriation (expropriation matérielle). L’expropriation n’est admissible que dans les cas d’utilité publique déterminés par une loi et dans la mesure où la réalisation de l’ouvrage correspond à un intérêt public. Le chapitre III du livre I définit la composition et le fonctionnement de la Commission d’expropriation.

This Law provides for the acquisition of land needed for public purposes and for Companies, and determines the amount of compensation to be made on account of such acquisition. The Collector of the District may make a preliminary investigation on any land in any locality that may be needed for any public purpose or for a Company. The Commissioner, for land acquired for a public purpose, or the Provincial Government for land acquired for a Company, when satisfied of the result of the investigation, shall publish a notification in the Official Gazette.

This Act provides for the establishment of Village Courts, defines their functions and jurisdiction and defines the relationship between village courts and other courts.The Minister may, by Notice in the National Gazette, establish a Village Court in and for an area specified in the Notice. A Village Court shall be constituted by Village Magistrates. The Village Courts shall have a well-defined civil jurisdiction in respect of disputes regarding land. The Village Courts shall also have specified criminal jurisdiction.

This Regulation implements provisions of the Village Courts Act 1989 by prescribing conditions of service of Village Magistrates in Village Courts and by prescribing offences for the purposes of section 22(a) of the Act. Among the offences are listed intentional damage to trees, plants or crops belonging to another person and intentional damage to trees, plants or crops belonging to the defendant and another person.

This Act defines rights and duties of parties involved in agreements relating to the right to the use of property in return for remuneration, and provides for arbitration between parties. The Act consists of 9 Chapters divided into 34 sections.Chapter II designates the department under the Ministry of Works and Human Settlement to be the tenancy authority. Chapter III applies to rental units used as rented residential or commercial premises, and lease of non-agricultural land. The monthly rent shall be determined by an agreement between the parties as provided for in Chapter IV.

Agricultural Tile Drainage Installation Act (R.S.O. 1990, c. A.14).

The present Act lays down provisions relating to the construction of drainage works, that is a drainage system constructed of tile, pipe or tubing of any material beneath the surface of agricultural land, including integral inlets and outlets, to improve the productivity of the land drained. According to section 2 no person shall carry on the business of installing a drainage work unless he or she is the holder of a licence released the Director.
