Act No. 93 creating the Fund for Lands and Agricultural Reform - 'Banco da Terra'.

This Act creates the Fund for Lands and Agricultural Reform - 'Banco da Terra' aimed to give financial assistance in order to enforce rural programmes. It consists of 14 articles specifying the requirements to be satisfied in order to obtain these incentives for agricultural development. Beneficiaries of this financial assistance programme are: farmers non-owners (working under concession, leasing, etc. for more than 5 years in agro-zootechnics); owners of agricultural lands for family sustenance (according to article 4 of Law No. 4.504 of 30 November 1964).

Les dispositions de la présente loi ont pour objet de définir les concepts et les principes d’une gestion rationnelle de l’espace pastoral et de déterminer les règles précises devant régir l’ensemble des aspects de l’activité pastorale de manière à assurer la préservation et la promotion du pastoralisme dans le cadre d’une évolution harmonieuse du développement rural. The present Act establishes that a registered owner, a municipality where the land is located, or any other person claiming an interest may apply to the Court of Queen’s Bench for an order to subdivide land. This Act applies also when two or more persons engaged in farming operations have a tenant in common title, or when a single owner actually holds the title for persons jointly engaged in farming operations of that land. The Act consists of 11 sections.

La presente Ley tiene por objeto el fomento, desarrollo y protección integrales del sector agrario. Para la ejecución de la política agraria (cap. IV), mediante el artículo 23, se crea el Instituto Nacional de Desarrollo Agrario (INDA), como entidad de derecho público, con ámbito nacional, personalidad jurídica y patrimonio propio, adscrito al Ministerio de Agricultura y Ganadería. El INDA substituye en sus funciones al Instituto Ecuatoriano de Reforma Agraria (IERAC).

The Law consists of 33 articles and is divided into four Chapters: General provisions (1); The Citizens' land (2); Lands belonging to the State, municipalities, cooperative farms and other legal persons (3); and Land property authorities (4).The Law regulates the ownership and use of agricultural lands. With the exception of game reserves and other nature protected areas with national and international significance, ownership is returned to owners whose land was taken under the April 1946 Law of landownership.

The purpose of this Law is the determination, delimitation, allocation of areas such as ranges, pastures, wintersheds (winter range lands) or highlands to juridical entities like villages or municipalities and making use of them in a manner abiding by the rules, increasing or sustaining productivity through maintenance and improvement, controlling that use continuously, protecting them and changing their purpose of use when necessary. The determination, delimitation and allocation of ranges, highlands and wintersheds are undertaken by the Ministry of Agriculture and Rural Affairs.

Tigray National Regional State's Rural Land Usage Proclamation No. 23/1997.

This Proclamation lays down rules relative to the ownership and use of land in the National State of Tigray. Land is declared to be "joint property" of the State and can not be sold, exchanged, given in lease or as bond for an indefinite time. Farmers may use land in their possession under conditions as set out in this Proclamation. The actual state of land is declared to be "accepted" under the present Proclamation. Farmers can give their land in lease under article 7. Article 8 concerns the lease of state land.

Act relative to the obligation to provide information in the agricultural sector.

This Act imposes the obligation to provide information on operations for persons who operate in agriculture and forestry and traders in commodities as defined in section 1. These persons shall provide information on means of production, farming, and use of land and use of energy as specified in section 2. The information is used for statistical purposes and for the Register of agricultural enterprises. An authority to be appointed by the Government shall collect the information. The State Agricultural Agency shall carry out control functions in the framework of this Act. (10 sections)

The present Law determines legal basis for setting up, functioning and liquidation of agricultural entrepreneurial activities (dehkan farms), regulates their rights and duties, and also relations with other legal and natural persons.
