This Regional Law regulates relations concerning tenure and conservation of land. Natural and legal persons shall have equal access to purchase in ownership of the plots of land. Local government shall have municipal property related to the following categories of land: (a) recognized as municipal land by federal and regional legislation; (b) right to which originates from delimitation of public property to land; (c) land purchased in accordance with civil legislation; and (d) land transferred free of charge out of federal property.

This Act carries into effect provisions of Title 7.5 of the Civil Code (on land lease), which incorporates provisions of the land Lease Act which has been repealed at the coming into force of the Title. The provisions here implemented concerning Land Tribunals to be designated by the Crown. There shall also be a Central Land Tribunal. The Land Tribunal shall have jurisdiction in applications for the approval of (modification or ending) land lease agreements.

This Act amends principally the Crofters (Scotland) Act 1993 and consequentially the Crofting Reform (Scotland) Act 2010 in respect of applications to decroft by owner-occupier crofters and the subsequent handling of such application by the Crofters Commission. The Act also provides with respect to appeals against decisions of the Commission. An owner-occupier crofter may apply to the Commission for a decrofting direction, i.e. a direction that the owner-occupier’s croft is to cease to be a croft.

The present Act lays down provisions relating to public lands. The Minister shall have charge of the management, sale and disposition of the public lands and forests. For the purpose of the present Act “mines and minerals” includes gold, silver, copper, lead, iron and other mines and minerals, and quarries, and beds of stone, marble or gypsum. This Act provides with respect to leases and sales of settled estates. “Settled estates” signifies land, and any estate or interest therein, which is the subject of a settlement. “Settlement” signifies any instrument under or by virtue of which any land or any estate or interest in land stands limited to or in trust for any persons by way of succession. The Act sets out requirements and procedures for to leases and sales of (rights on) settled estates under authority of the court or by a tenant for life.
