These Rules require that there shall be maintained in Port Vila a Land Records Office in which shall be kept a register to be known as the Land Leases Register. These Regulations provide for matters of the land Records Office such as Hours of public business of the Office, amendments, corrections, erasures, etc. of register, lodgement for registration, fees, evidence of incorporation, execution of instruments by corporations, attestation of instrument, persons interested in instruments may not attest, deposit of deeds in archives.

Le présent décret fixe les règles relatives à la création des lotissements privés (dépôt et instruction du dossier de lotissement) ; les lotissements créés par les municipalités; les lotissements crées par l’Etat; et les sanctions.

Le présent décret régit les transactions immobilières privées (la vente, la cession gratuite ou l’échange d'un immeuble entre particuliers). Tout immeuble ne peut faire l’objet de transactions par parcelles qu’après un lotissement approuvé. Par ailleurs, ce texte décrit la procédure et le contenu du dossier de la transaction.

Le présent décret fixe les modalité d'application de l’ordonnance n° 10 du 5 mars 1976 relative à l'exercice et à l’organisation de la profession de géomètre. A cet effet, ce texte rappelle la liste des travaux énumères à l’article premier de l’ordonnance susmentionnée. Par ailleurs, elle définit l’agrément, la procédure d’agrément et les infractions et sanctions, en application de l’article 5 de l’ordonnance n°10 du 5 mars 1976.

This Act provides generally for registration of rights in land and land tenure in Belize. “Land” includes land covered with water, all things growing on land and buildings and other things permanently affixed to land. Except as otherwise provided in this Act, but subject to section 38 of National Lands Act, no law, practice or procedure relating to land shall apply to land registered under this Act so far as it is inconsistent with this Act.

La création d'organismes permanents d'enquêtes sur le terrain dans le cadre des services statistiques africains est à l'étude depuis de nombreuses années et dans certains pays ces organismes existent déjà. Ils se justifient par la nécessite de recueillir des informations relativement exactes sur les secteurs des ménages et des entreprises privées, qu'il est impossible d'obtenir de sources centralistes d'informations dans les pays en voie de développement.

The origins of the cadastre in Tunisia go back to the Roman occupation. The vestiges of a Roman cadastral system were first brought to light through examination of plans and topographical maps established from ground surveys; from this examination it was possible to determine the characteristics of both the orientation of the lines arid the dimensions of the grid.

Les origines du cadastre en Tunisie rementent à l'occupation romaine. Au début, la découverte de vestiges de cadastration romaine a pu se faire grâce a l'examen de plans et cartes topographiques levés par des procédés terrestres; cet examen a permis de tirer les caractéristiques de ‘orientation des lignes et des dimensions du carroyage.

Les terres agricoles plates sont dans les pays en voie de développement la principale ressource de l’économie. Il importe que ces terres soient à la fois cartographies et divisées en parcelles convenablement délimitées.

Cependant la plupart des pays intéressés ont grand besoin de cartes exactes; certains en manquent même totalement. Dans ce cas, il serait déraisonnable de réaliser des levés et des cartes classiques pour délimiter les terres.

These Rules implement provisions of the Registered Land law by prescribing forms and the form of the register and by providing with respect to fees. A register shall be in one of the forms prescribed in the First Schedule. A land certificate and certificate of lease shall be in the forms prescribed in the Second Schedule. Other forms required to be used under the Law shall be in the forms prescribed in the Third Schedule. The Rules also define public officers for purposes of the Law. The fees payable under section 157(1) of the Law are prescribed in the Fourth Schedule.

These Regulations provide with respect to land surveys, making of boundaries and survey plans. They also, in the Schedule prescribe forms and fees. If a dispute arises between a licensed surveyor and the Chief Surveyor over the application of the Regulations, either party may refer the matter to the Land Surveyors Board. The Board shall hear and determine such dispute, and its decision shall be final.
