Recognition of the potentially deleterious implications of inequality in opportunity originating in a skewed asset distribution has spawned considerable interest in land reforms. However, little attention has been devoted to fact that, in the longer term, the measures used to implement land reforms could negatively affect productivity. Use of state level data on rental restrictions, together with a nationally representative survey from India, suggests that, contrary to original intentions, rental restrictions negatively affect productivity and equity.

Although opinions on impacts of land market transfers are sharply divided, few studies explore the welfare and productivity effects of land markets on a larger scale. This paper uses a large Indian panel spanning almost 20 years, together with a climatic shock (rainfall) indicator, to assess the productivity and equity effects of market-mediated land transfers (sale and purchase) compared with non-market ones (inheritance). The analysis shows that frequent shocks increase land market activity, an effect that is mitigated by the presence of safety nets and banks.

Understanding changing land access issues for the rural poor in Uganda

The ways in which people obtain land in Uganda are changing fast. Land that used to be secured through inheritance, gifts or proof of long-term occupancy is now more commonly changing hands in the market. Those with wealth and powerful connections are frequently able to override local rules and gain access to land at the expense of poorer individuals. Government-backed agribusiness investors receive large areas of land with benefits for some local farmers who are able to participate in the schemes, while other smallholders see their land access and livelihoods degraded.

Increasingly, social capital, defined as shared norms, trust, and the horizontal and vertical social networks that facilitate coordination and cooperation for mutually beneficial collective action, is seen as an important asset upon which people rely to manage natural resources and resolve conflicts. This paper uses empirical data from households and community surveys and case studies, to examine the role, strengths, and limits of social capital in managing conflicts over the use and management of natural resources.

The need to establish the link between land tenure and food security is increasingly gaining currency as governments and development organizations refocus their effort towards assisting farmers to move away from subsistence farming to commercial agriculture. It is argued that given how land plays a crucial role in the livelihoods of most Africans, food security and poverty reduction cannot be achieved unless issues of access to land, security of tenure and the capacity to use land productively and in a sustainable manner are addressed.

Conflict associated with land has increased substantially following the return of peace to the Acholi Region with the return of internally displaced people (IDP), population growth, and increases in the value of land. The area is heavily dependent on agriculture and conflict related to land access seriously threatens to undermine development and the social, political and economic stability of the Acholi Region. This study involved community members, key informants, and statutory and traditional leaders in three sub counties in each of the seven Acholi districts.

Does customary tenure have a role in modern economic development?

Over 80% of all land in Uganda is held under unregistered ‘customary tenure’. This means that it is private property, but the owners need no documents to prove ownership. Their claims to the land, and the boundaries of the land, are locally recognised, and this recognition is given the full protection of State law.

Although much is known about the topics of land governance and food security, it is not always clear how the two relate to each other, especially in specific country contexts. This reflection paper, based on literature, LANDac country factsheets and three learning trajectories initiated by LANDac in Uganda, Ghana and Ethiopia, brings together findings and outcomes to provide policy recommendations for improved land governance and food security in Africa.

Food security in Uganda relies mainly on access to land and security of tenure. Land governance is marked by the contradiction between relatively progressive legislation and only partial implementation. Institutions that have to deal with land administration and land disputes, such as customary authority systems, local government, and special courts for land justice, have weakened in the last years. Women’s position with respect to land and inheritance also remains weak, both legally and in practice, undermining their livelihoods and status in society.
