The areas of land described in the Schedule are hereby declared to be planning areas for purposes of the Town and Country Planning Ordinance (para. 4). Subject to paragraphs 6 and 7 no development other than conservation and water-related activities shall be carried out within such area without a planning consent or contrary to a planning scheme prepared by the Minister (para. 5). "Water-related activities" includes tourism, aquarecreation, luxury beach hotels, boat and ship building, harbours, mining, security structures, and fishing (para. 3).

These Regulations amend the principal Regulations which provide for payment to eligible persons who, in respect of an area of eligible land, undertake not to use such land for a period of at least twenty years and to manage the land with the objective of establishing an area of salt-marsh in accordance with prescribed management requirements. They amend the rate of payment of aid to beneficiaries in respect of land which was permanent grassland at the start of the management period.

This Act places restrictions on the removal of soil on land and in the sea. It is forbidden to remove soil on public or private land without a soil removal permit (art. 3). The permit is not required for soil removal carried out to prevent flooding, for the carrying out of a Town and Country Planning Plan, or the carrying out of a Provincial Environmental Programme (art. 6). The State owns shells, sand, stones, or mud on or under surface waters of the Continental Shelf (art. 4(b)).

These Regulations provide for aid to eligible persons, defined in regulation 2, who undertake not to use eligible land for agricultural purposes for a period of 10 years. The beneficiary agrees with the Secretary of State upon a programme of management for the land and shall comply with obligations undertaken under these Regulations.

These Regulations add a new payment rate for aid for set-aside land managed in accordance with the management obligations in the principal Regulations 1994. Now the beneficiary may alter the area of land to be counted as set-aside land during the management period. Requirements concerning information to be included in the application for aid are also amended. The provisions regarding recovery are altered so as to give the Minister power to recover the difference between the old and the new payment rate. (9 regulations)

The purpose of this Law is to provide for the protection and management of coast, shore and bank areas. Protection and management shall be based on principles of sustainable development and preservation of biological diversity (art. 1). Article 2 defines coasts, shores and banks as land areas bordering the sea, lakes, rivers, reservoirs and water courses, which for the purposes of this Law start at the "mean" water level line (art. 2).

Ministerial Decree approving the special plan for the completion and rationalization of the water catchment and purification systems.

Based on the assessment of the present environmental degradation caused by the inadequacy of the purification systems, and of the data collected through an official census on the water pollution of the country, the special plan aims at the achievement of the following objectives: (a) identification and implementation of urgent interventions necessary for the protection and sanitation of waters and catchment basins; (b) completion of works already financed; (c) putting into operation of completed works. The Decree establishes criteria and modalities for the elaboration of the plan.
