This Scheme makes provision for the making of grants in respect of agricultural businesses which are situated in nitrate vulnerable zones, as defined by paragraph 4 of the Schedule to the Protection of Water against Agricultural Nitrate Pollution (Amendment) (Wales) Regulations 2002.

Contaminated land depending upon the type and the level of contamination or indices of negative impact upon human health and environment caused by contamination, shall be transferred into reserve land for the purpose of conservation, shall be used in conformity with purposeful use thereof under special conditions of land tenure and shall be used in conformity with purposeful use thereof without the establishment of special conditions of land tenure if contamination level and indices of negative impact do not exceed the established rates.

The purpose of the present Law is to establish the legal basis for keeping state land cadastre, use of cadastre data for economic development, ensuring the right to the plots of land, rational use, rehabilitation and protection of land. State land cadastre is a basic component of the Common system of state cadastres and represents the system of data and documentation regarding natural, economic, legal characteristics of land, categories, qualitative aspect and value, location and size of the plots of land, distribution among the owners, leaseholders and landlords thereof.

This Chapter provides for public access to the ocean shore, i.e. land between the mean low waterline and series of lines connecting angle points prescribed in section 3. Extensive areas of ocean shore are inaccessible to the public due to the absence of public rights-of-way and the ocean is a vital part of the patrimony of the people of Guam and is a major source of recreation and livelihood. In order to safeguard access to the ocean shore this Chapter provides for protection and maintenance of traditional rights of way to the ocean.

This Law sets forth the rules and principles for determining land and soil resources and their classification, preparing land utilization plans, preventing non-purpose utilization, and defining the tasks and obligations to ensure land and soil preservation. Soil Preservation Boards are established in each province to examine, assess and monitor the activities related to the preservation, development and productive utilization of lands. Lands are classified as absolute farming lands, special crop lands, cultivated farming lands and marginal farming lands.

This Chapter provides for a policy of coastal zone management and in particular safeguards public rights of access to the ocean shore (as defined in section 4).

The present Regulation establishes the modalities of issue and cancellation of special permits for removal and transfer of the fertile soil layer of the plots of land. The provisions of the Regulation establish the modalities of application for obtaining special permit for removal and transfer of the fertile soil layer of the plots of land that are compulsory for land users whose activity is related to the disturbance of the upper (fertile) soil layer.

The present Regulation is applicable to the Ministry of Environmental Protection and its territorial branches (environmental institutions). The Regulation establishes the mechanism of approval by the environmental institutions of the selection of the plots of land for the location of the objects thereon, allotment of all categories of land irrespectively of the form of ownership and land tenure.

Al fin de evitar que se repitan focos de insalubridad constituidos por el inadecuado uso del guano, la presente Resolución dispone la prohibición del acopio y utilización de guano directo al suelo, en la jurisdicción que indica, salvo que el mismo haya sido sometido a compostaje u otro sistema de estabilización o manejo que impidan la reproducción y proliferación de moscas en cada una de las etapas del proceso de mejoramiento del suelo agrícola. El artículo 2º establece los particulares requisitos a ser cumplimentados por las instalaciones de estabilización de guano.

The present Act, which is composed of 35 Paragraphs, has been adopted to ensure the development of agriculture and forestry by improving the area structure of farms, forests and forest lands, and by adapting borders of immovable properties to the system of water drainage, roads and terrain features. Integration applies to lands placed in one or several villages or their parts. However, it does not apply to lands where mining or industrial plants, historic or architectural monuments, sanctuaries, lands used for fishery or allocated for special purposes exist.
