The present Act is a piece of basic legislation that governs in matters pertaining to Indian status, bands, and Indian reserves. It has been suggested that the Indian Act provides ways of understanding native identity, organizing a conceptual framework that has shaped contemporary native life in ways that are now so familiar as to almost seem “natural”. The Indian Act is administered by Indian and Northern Affairs Canada (INAC), formerly the Department of Indian Affairs and Northern Development (DIAND).

There is hereby established a Department of the Government of Canada called the Department of Indian Affairs and Northern Development over which the Minister of Indian Affairs and Northern Development appointed by commission under the Great Seal shall preside. Section 5 establishes that the Minister shall be responsible, inter alia, for coordinating the activities in Yukon, the Northwest Territories and Nunavut of the several departments, boards and agencies of the Government of Canada. This Order lays down some amendments to the Environment and Development Planning Act of 1992. It transposes and implements certain provisions of Directive 2003/35 EC of the European Parliament and of the Council providing for public participation in respect of the drawing up of certain plans and programmes relating to the environment.

The purpose of the present Act and orders of the Governor in Council made pursuant to this Act is to bring into effect self-government agreements concluded with First Nations. The Act deals, inter alia, with the following issues: First Nations constitutions, First Nations Laws, administration of justice, laws of general application, disposition of reserve lands, transitional provisions. The Contracting Parties shall promote the cooperation in the field of spatial planning, land use planning and regional policy. The Northeastern Quebec Agreement (NEQA) settles the land claims of the Naskapi Indian band, exchanging their claims, rights and territorial interests for other rights and benefits. Signatories to the Agreement include the Naskapi Indian Band, the Government of Quebec, the James Bay Energy Corporation, the James Bay Development Corporation, the Quebec Hydro-Electric Commission (Hydro-Quebec), the Grand Council of the Crees (of Quebec), the Northern Quebec Inuit Association, and the Government of Canada.Under the Agreement the territory was divided into three categories.

The present Act is made under the James Bay and Northern Quebec Agreement. In particular, the Act deals with Category IA and Category IA-N native lands and their local administration. Category IA lands are those that were transferred from the Province of Quebec to the Government of Canada for the exclusive use and profit of the Cree bands in the James Bay region.

The present Act approves, gives effect and declares valid the Agreement between the Crees of Eeyou Istchee and Her Majesty the Queen in Right of Canada concerning the Eeyou Marine Region. The present Agreement constitutes the full and final settlement in respect of the aboriginal rights, including the aboriginal title, of the Crees of Eeyou Istchee with respect to the use and ownership of lands and Resources in Nunavut and in the area comprising Hudson Bay and James Bay. Furthermore, the Agreement settles the land and resource rights, including those of Canada and the Crees, over the islands and the marine waters in this area.

The present Act approves, gives effect to and declares valid the Agreement between the Committee for Original Peoples’ Entitlement, representing the Inuvialuit of the Inuvialuit Settlement Region, and the Government of Canada. For the purpose of the present Act “Territory” means the Northwest Territories, Yukon and adjacent offshore areas, not forming part of the Northwest Territories or Yukon, within the sovereignty or jurisdiction of Canada. The present Agreement - made under section 35 of the Constitution of Canada - is a basic document that lays out the governing power of each of the 5 Maa-nulth First Nations. Each of the five nations has their own constitution . This means that they have the authority to enact laws and govern themselves. The law-making powers include lands and land management, such as land ownership, land registration, expropriation, sub surface ownership, protection of land base, submerged land, watershed land. Other fields are social development, cultural heritage, education, economic development.
