There is hereby established a Department of the Government of Canada called the Department of Indian Affairs and Northern Development over which the Minister of Indian Affairs and Northern Development appointed by commission under the Great Seal shall preside. Section 5 establishes that the Minister shall be responsible, inter alia, for coordinating the activities in Yukon, the Northwest Territories and Nunavut of the several departments, boards and agencies of the Government of Canada. This Order lays down some amendments to the Environment and Development Planning Act of 1992. It transposes and implements certain provisions of Directive 2003/35 EC of the European Parliament and of the Council providing for public participation in respect of the drawing up of certain plans and programmes relating to the environment.

The purpose of the present Act and orders of the Governor in Council made pursuant to this Act is to bring into effect self-government agreements concluded with First Nations. The Act deals, inter alia, with the following issues: First Nations constitutions, First Nations Laws, administration of justice, laws of general application, disposition of reserve lands, transitional provisions. The Contracting Parties shall promote the cooperation in the field of spatial planning, land use planning and regional policy. The Northeastern Quebec Agreement (NEQA) settles the land claims of the Naskapi Indian band, exchanging their claims, rights and territorial interests for other rights and benefits. Signatories to the Agreement include the Naskapi Indian Band, the Government of Quebec, the James Bay Energy Corporation, the James Bay Development Corporation, the Quebec Hydro-Electric Commission (Hydro-Quebec), the Grand Council of the Crees (of Quebec), the Northern Quebec Inuit Association, and the Government of Canada.Under the Agreement the territory was divided into three categories.

The present Act is made under the James Bay and Northern Quebec Agreement. In particular, the Act deals with Category IA and Category IA-N native lands and their local administration. Category IA lands are those that were transferred from the Province of Quebec to the Government of Canada for the exclusive use and profit of the Cree bands in the James Bay region.

The present Act approves, gives effect to and declares valid the Nisga’a Final Agreement. Section 9 establishes that there shall be paid out of the Consolidated Revenue Fund the sums that are required to meet the obligations of Canada under the Capital Transfer and Negotiation Loan Repayment Chapter and the Fisheries Chapter of the Nisga’a Final Agreement. The basic goals of the present Agreement - made under section 35 of the Constitution of Canada - are to: 1) preserve Inuvialuit cultural identity and values within a changing northern society; 2) enable Inuvialuit to be equal and meaningful participants in the northern and national economy and society; 3) protect and preserve the Arctic wildlife, environment and biological productivity. In the Agreement, the Inuvialuit agree to give up their exclusive use of their ancestral lands in exchange for certain other guaranteed rights from the Government of Canada.

For the purpose of the present Act “Agreement” means the Maa-nulth First Nations Final Agreement, between the Maanulth First Nations, Her Majesty in right of Canada and Her Majesty in right of British Columbia, including any amendments made to it. Section 4 establishes that the Agreement is approved, given effect and declared valid and has the force of law. The text consist of 25 sections.
