La presente Resolución da por concluido el proceso de fusión entre el Proyecto Especial Titulación de Tierras y Catastro Rural (PETT) y el Organismo de Formalización de la Propiedad Informal (COFOPRI), en calidad de entidad incorportante, declarando en consecuencia extinguido el PETT.

Ministerial Decree No. 1275 regulating timber extraction on urban land.

This Ministerial Decree regulates timber extraction on urban land pertaining to forest estate, including urban forests. Citizens who have been allotted plots of urban land as lifelong hereditary estate, usufruct, ownership or lease shall have the right to cut trees and shrubbery thereon without any prior authorization of the local self-government except for cases envisaged by the legislation. Legal and natural persons who have caused in the process of cutting illegal damage to other plant or forest species or growing conditions thereof shall be liable for compensation of damages.

The purpose of this Law is to clarify the ownership of property and to protect property rights including rights relating to land.This Law shall apply to civil relationship arising from the ownership and utilization of property including movable and real property. Real or movable property may be owned jointly by two or more institutions or individuals and may be of two kinds, namely co-ownership by proportion and common ownership. Registration shall be granted for the establishment, modification, transfer and lapse of the right in real property by the registration department.

Decree No. 1 of the Committee on Land Resources, Geodesy and Cartography validating the Regulation on making up, issuing and storage of state land certificates and provisional land tenancy certificate.

This Decree shall be destined for entities making up state land certificates and provisional land tenancy certificate and local self-government that issue and store public deeds and for legal and natural persons who shall be the holders of the aforesaid certificates. The right of private ownership, lifelong hereditary possession by the Belarusian nationals, legal persons, including companies with foreign investments of the plots of land, and also the right of open-ended land tenancy shall be attested by the public deed to land.

This Ordinance provides for the acquisition of land, held under a possessory title, required for public purposes.An acquisition order shall be made by the Director for any land required for public purposes. The land shall vest in the Government free of all interests, rights or easements along with the right to enter upon and take possession of it. The Ordinance makes further provision for claim of ownership of land acquired; compensation; etc.

Order No. 146 of the Federal Registration Service validating the form of the abstract of record from the real estate register certifying the right to a plot of land.

Abstract of record from the real estate register certifying the right to a plot of land specifies land category of the plot of land, the type of right, purposeful use of land, land area and cadastre number. The abstract shall be applicable to agricultural land allotted for subsidiary small-holding.

This Act defines powers and duties of Curator of Vacant Estates in respect of vacant estates and provides for the administration of such estates by the Curator.The Officer of the Curator of Vacant Estates is created under this Act and the Curator shall be appointed by the President. “Vacant Estates” shall comprise vacant successions and unclaimed property. The Curator shall act on the authority of a Vesting Order to be issued by a judge after procedures as prescribed by this Act have been completed.

El presente Decreto contiene la reglamentación de la Ley Nº 26.160, mediante la cual fue declarada por un período de cuatro años la emergencia en materia de posesión y propiedad de las tierras que tradicionalmente ocupan las comunidades indígenas originarias del país. El Instituto Nacional de Asuntos Indígenas queda designado como autoridad de aplicación de la Ley y estará encargado de aprobar los programas para el relevamiento técnico y jurídico-catastral de la situación dominial de las tierras ocupadas por las comunidades indígenas.
