La presente Ley modifica el Texto Refundido de las Leyes de Ordenación del Territorio de Canarias y de Espacios Naturales de Canarias, en aspectos relacionados con el régimen jurídico a aplicar a las instalaciones, construcciones y edificaciones, así como a los usos ya existentes.

This Law approves the National Directive for Territorial Planning (DNOT). This Directive, consisting of 4 Sections, specifies the basic legislation for territorial planning and its management, as established by Legislative Decree No. 1/2006. The Directive is an instrument for the National territorial management, which establishes the legal spatial framework and defines the great options for the socio-economic development of the National territory.

This Act grants powers to the Minister to constitute Forest Reserves and lays down rules relative to acts in or in relation with such reserve. The Minister may constitute a Forest Reserve by Order published in the Official Gazette and may also direct, in the same manner, the cessation of a Reserve. Provisions of the State Lands and River Reserves Act notwithstanding, the President or the government may not sell, lease or mortgage land in Forest Reserves. Cutting down of trees or lighting of fires without a written permission of the Chief Agricultural Officer is prohibited.

This Act makes provision for the management and alienation of State land, for the appointment of forest rangers and for the protection of State lands and River Reserves.State land may be alienated by grant, sale or lease. State land may be sold by the President, with the exception of River Reserves belonging to the Republic. River Reserves are rivers and “rivulets” and adjacent areas listed in Schedule A to this Act. The Minister may, from time to time, add to or withdraw from the Schedule any watercourse.

The purpose of this Act is the determination of terms regarding the utilization of land in each area of the country, the equal distribution of technical and infrastructural works, taking into consideration the principle of sustainable development, the protection of territorial, natural, ecological and cultural features and values, and the conservation of natural resources.

The present Act lays down provisions relating to provincial parks.

This Act creates a framework for the designation and management of Crown land as park land or recreation areas. In such areas, the Minister must administer the following: government rights, property and interests, wildlife and its habitats, preservation, development use, etc. of these areas and their natural resources; the regulation and control of public and private use or exploitation of these areas and their resources, and of human activity and conduct (sect. 3). This Law establishes legal and organizational grounds for activities in the sphere of land survey and is aimed at regulation of relations between state bodies, local government, legal and natural persons with a view of ensuring stable development of land tenure.

The purpose of the present Act is: a) to enable First Nations and aboriginal communities on the east side of Lake Winnipeg to engage in land use and resource management planning for designated areas of Crown land that they have traditionally used; and b) to provide designated areas of Crown land on the east side of Lake Winnipeg with special protection from development and other activities that might occur on that land.

Section 2 of the above-mentioned act establishes that the purposes of the present Act are to ensure that: a) the protection of the ecological integrity of the Kawartha Highlands Signature Site Park is recognized as the overriding priority in the management and administration of the Park, so as to preserve, protect and enhance the natural composition and abundance of native species, biological communities and ecological processes in the Park; b) the policies governing the Park, including its management, will protect the Park’s natural and cultural values, maintain its traditional uses and pr

The Act applies to Tøndermarsken area and aims to protect the outer borders and the lower part of watercourse Vidå and establish it as a conservation area of national and international interest. Construction, fishing, hunting and planting of trees and plants are not permitted. Dyke systems are applied to watercourses for water supply.

Article 90 shall be amended to add the following wording: “In order to prevent negative anthropogenic impact upon protected areas, including state nature reserves, national parks, natural parks and nature monuments on adjacent land areas and waterbodies shall be constituted protection areas”.
