Decree No. 8.468 regulating Law No. 997 on environmental pollution control.

This Decree approves the Regulation on environmental pollution control established by Law No. 997 of 31 May 1976. The Regulation consists of 7 Parts and 8 Annexes specifying in details all the requirements and conditions to be satisfied by industries, or any other activity which may contaminate the environment in order to prevent and control water, soil and air pollution. Part I establishes general provisions (including definition of prohibited activities and restrictions to be observed). Part II concerns water pollution, specifying water classification and standards to be satisfied.

A Regulation to implement provisions of the Water Act of 1983.The matters here further regulated deal with: protection of public interests under the Water Act (sects. 1,1a, and 2); the authority of a referee appointed under Chapter 12 of the Act (sects. 3 and 4); records at hearings conducted pursuant to Chapter 12 (in relation with land drainage projects) (sects. 5 to 14); communication of decisions of the Water Court to other public bodies and other communications and notifications of the Water Court (sects. 15 and 20); communication of maps, etc.

Every Water Court shall maintain a list of water projects in a water book for their jurisdictional district. The Book shall be organized in 4 divisions: water projects and water works designed to use water as a propelling force, and dam constructions (even if not so intended); water projects and water works for public waters; water supplies; other water projects and water works covered by the Water Act of 1982 (art. 1). Each of these divisions shall be organized according to river basins or, if necessary, sections of river basins.

This Decision of the Prime Minister aims at the encouragement and creation of favourable conditions for domestic organizations, households and individuals of all economic sectors as well as foreign investors to invest in the field of protection and development of aquatic breeding in order to reach objectives set out in article 1. Article 2 sets out some criteria for aquatic breeding.

The purpose of these Regulations is to regulate the use of sewage sludge (defined in reg. 2) in agriculture (defined) in such a way as to prevent harmful effects on soil, vegetation, animals and man and to promote the correct use of such sludge. No sludge shall be used in agriculture unless it is treated in accordance with these Regulations (reg. 3).

In order to comply with Council Directive 91/676/EEC concerning protection of water waters against pollution of nitrate from agricultural sources the norms regarding the use of nitrates are sharpened and charges increased by the present Act. Furthermore, rules are introduced so as to place further limits on the production of manure and to make the granting of production capacity dependent upon the capacity to use the manure on the producers' lands or to place that manure on the markets.
