This Law regulates relations regarding housing facilities, including plots of land pertaining to common property of condominiums. In case of demolition of residential building because of expropriation for public needs of the plot of land on which it was located the owner shall have the right to another residential space or compensation at his choice (art. 15). Transfer of residential space shall entail transfer of land ownership (land tenure) rights to a new owner (art. 19).

The present Law applies to land use planning of private and public parties in the whole of the Canton of Basel-Landschaft. The present Law applies to all expropriations carried out on the domain of the Canton. The expropriation right shall be enforced in the interest of the Canton, or part of it, or of local authorities. The present Law lays down provisions relating to expropriation and seizure proceedings in the Canton Basel-Stadt. The purpose of the present Law is to implement and complete the Federal Soil Protection Act of 17 March 1998 (BGBl. I p. 502). The present Ordinance implements the Federal Expropriation Act of 20 June 1930. Article 1 establishes that the President of the Compensation Commission shall decide on compensation payments. Article 2 lays down provisions relating to the competent office to execute compensation payments. The text consist of 3 articles.

The present Law lays down provisions relating to the assessment of land values. The text consists of 15 articles divided into 2 Parts as follows: Appraisal of value of land parcels (I); Official land valuation (II).

The present Law lays down provisions relating to compensation payments in respect of expropriation. Article 1 allows an expropriation to materialize projects which are for the well-being of the community. The text consists of 54 articles divided into 4 Parts as follows: General provisions (I); Compensation payments, restitutions proceedings, hardship clause (II); Compensation proceedings (III); Final provisions (IV).

The present Law applies to all expropriations where federal legislation or special regional legislation is not applicable.

The purpose of the present Law is to implement and complete the Federal Soil Protection Act of 17 March 1998 (BGBl. I p. 502). Article 1 establishes that the originator of a harmful change to the soil shall report this without delay to the competent authority.

The present Law is applicable to expropriation of general property proceedings and related compensation payments in so far as the Federal Act is not applicable. According to the present Law expropriation is authorized, inter alia, only for the purpose of carrying out projects aiming at the creating or modifying facilities or institute for the well-being of the community; to carry out projects for which other Laws expressly authorize expropriation.
