Land Use Planning Code.

This Code grants every citizen the right to a favourable environment ensured by sound land use planning through: (a) state regulation of land use planning activities; (b) planning of urban land; (c) compensation for damages resulting from violation of land use planning legislation; and (d) liability.

Law on compulsory transfer of property (Expropriation Law).

Article 1 of the present Law establishes that the compulsory transfer of property is admitted only if necessary and in the public interest; in such a case a full compensation shall be paid. The expropriation can apply to moveables, immoveables and rights and can be permanent or temporary In principle, expropriation of private property shall be limited to the minimum unavoidable.

Law No. 94-1 on housing facilities.

This Law regulates relations regarding housing facilities, including plots of land pertaining to common property of condominiums. In case of demolition of residential building because of expropriation for public needs of the plot of land on which it was located the owner shall have the right to another residential space or compensation at his choice (art. 15). Transfer of residential space shall entail transfer of land ownership (land tenure) rights to a new owner (art. 19).
