Ministerial Decree No. 65 on expropriation of land for public needs.

This Ministerial Decree regulates submittal and examination of the applications for the expropriation of land for public needs, assessment of compensation of damage caused thereby to landowners and other land managers. Expropriation of land for public needs shall be carried out by: (a) decision of the head of local administration for areas of up to one hectare in the cities and for up to ten hectares in the countryside; and (b) governmental decision for the areas exceeding the aforesaid limits.

The present Ordinance lays down provisions relating to a programme for the safety measures of human agglomerates in case of floods. In particular, the aim of the above-mentioned programme is the minimalization of damages done by flooding, occurring usually every 100 years, by way of land use planning measures. The text consists of 6 articles and 1 Annex.

This Provisional Regulation establishes the modalities of calculation of calculation of economic damage caused by soil pollution, land degradation and land disturbance and also the modalities of collection and use of compensation fees. It consists of five Sections dealing with: (1) sphere of application; (2) terms and definitions; (3) general provisions; (4) calculation formula; and (5) collection and use of compensation fees. Economic damage shall be considered the expenditure for soil rehabilitation and recultivation of land.

Oil Pollution (Land Use and Requisition) Ordinance (Chapter 247).

This Ordinance lays down measures to prevent pollution of the waters and foreshores of Hong Kong from oil spillage.Any public officer shall have the power to enter and requisition any land or requisition any property in order to prevent, clear up or repair from pollution caused by oil spillage. The Ordinance further provides for compensation, liability for costs of cleaning-up operations, and offences.

Land Acquisition (Possessory Title) Ordinance (Chapter 130).

This Ordinance provides for the acquisition of land, held under a possessory title, required for public purposes.An acquisition order shall be made by the Director for any land required for public purposes. The land shall vest in the Government free of all interests, rights or easements along with the right to enter upon and take possession of it. Law on the Rights of Landowners to Compensation for Restrictions on Economic Activities in Specially Protected Nature Territories and Microreserves.

This Law provides conditions by which compensation for restrictions on economic activities in protected territories established by the State or local governments shall be granted and the procedures for granting such compensation. Compensation granted for restrictions on economic activities in protected territories shall be divided as follows: (a) reimbursement; and (b) exchange of a land parcel situated in a protected territory to an equivalent land parcel owned by the State or local government.
