Private Managed Forest Land Act ([SBC 2003] Chapter 80).

The present Act applies to private managed forest land other than land that is in a tree farm licence area, a woodlot licence area or a community forest agreement area. Section 4 decrees that the Private Managed Forest Land Council is established as a corporation consisting of the members appointed under section 6. The object of the council is to encourage forest management practices on private managed forest land, taking into account the social, environmental and economic benefits of those practices.

This Act provides rules relative to the carrying out of excavations, quarrying of mines and landfill operations and the control of such activities affecting the soil and landscape. The Act also provides for the protection of trees in certain circumstances.The Minister is charged with the responsibility of regulating excavation, landfill operations, quarrying, mining and harvesting of protected trees in The Bahamas, for the purpose of providing for and ensuring the conservation and maintenance of the environment.

This Law establishes exclusive plenary powers of the self-government bodies in the following areas: (a) management and disposal of public land resources; (b) land use planning; (c) management of local public forest and water resources; and (d) management of local water supply, drainage and sewerage systems (art. 16). The local self-governing representative bodies (Sakrebulo) shall have plenary powers in the following areas: (a) establishment of management rules and regulations applicable to local public land, forest and water resources; and (b) land use planning (art. 22).

These Regulations implement provisions of the Conservation and Protection of the Physical Landscape of The Bahamas Act, 1997 concerning the application for, and the granting of, permits for excavation or landfill operations or the to harvesting of protected trees and a licence to quarry or mine. Applications, permits or licences shall be in the form as set out in the Schedule to these Regulations.

This Ministerial Decree stipulates that national parkland may be leased for recreational activities in accordance with land legislation, legislation on protected areas and this Regulation. The following plots of land located within the boundaries of any national park may be leased: (a) areas of tourism; (b) areas of ecological education; and (c) recreational areas. Lease contracts must contain terms and conditions, location, purpose of use and authorized activities, and also a prohibition on subleasing the land.

Ministerial Decree No. 384 on valuation of land under forest stock.

This Ministerial Decree establishes that the cadastre value of land under forest stock shall be established according to the forest group, protection category and type of management, and shall be adjusted according to the annual index adjusted for inflation. Cadastre value of land under forest stock shall be used to calculate land charges for plots of forestland allotted for the construction and servicing of gas pipelines, oil pipelines and power supply lines.

Article 1 of the above-mentioned Law establishes that the division of forest land as a result of which a remaining part of land would reach no longer the minimum size for forestry management is forbidden. The minimum size is 1 ha and a minimum width of 40 m. However, if the public interest prevails such divisions are permitted as, for instance, in case of water works, mining activities, energy resources, improvement of agricultural structure, land reform, and so on. The text consists of 8 articles.
