L’annulation du principe de la présomption de domanialité ainsi que la mise en place de la propriété foncière privée non titrée par la loi n°2005-019 du 17 octobre 2005 fixant les statuts des terres à Madagascar a impliqué une révision de la loi sur le domaine privé national. La présente Loi établit les nouvelles modalités de gestion de son patrimoine, notamment immobilier et mobilier par l’Etat.

This Ministerial Decree establishes that Department on cadastre and registration of rights to immovable property shall be responsible for keeping land cadastre, mapping, registration of rights to immovable property and ensuring legal protection of registered rights to immovable property.

The Act (46 sections, 1 Schedule) is divided into 9 Parts: Preliminary (I), Acquisition of land (II), Procedure for compulsory acquisition of land (III), Claims for assessment and payment of compensation (V), Compensation for agricultural land required for resettlement purposes Va), Derelict Land Board (VI), Provisions relating to derelict land (VII), Special provisions relating to the Administrative Court (VIII), General (IX).

Access to arable productive land in African has been in decline due to the pressure of growing population trends and worsening land degradation as a result of climate change. Recent high profile land purchases covering thousand of hectares of prime agricultural land have raised concerns over equitable land access. Major expansions in regional land markets have increased investor interest in land acquisitions. Perceptions of land availability and competitive land prices have driven demand for prime agriculture land.

This paper was prepared within the “Cooperatives and their alternatives” component of the Agrarian Structures Initiative (ASI) which a regional program of FAO in Europe and Central Asia. The purpose of this paper is to introduce Central Asian policy makers to the Western paradigm of service cooperative and to explore the constraints – both physical and ideological – to faster development and acceptance of cooperatives. We also discuss the need for a complete reorientation of the government’s approach to cooperative development.
