Real and Personal Property Act.

This Act shall apply to any agreement, regardless of its form, which is intended to give rights in personal property, including houses on land not owned individually or entirely by the party or parties purporting to give an interest in the house, as security for the performance of any obligation. Such Agreements include, among others, pledges, conditional sales agreements, chattel mortgages, and leases under which ownership of personal property is to pass upon completion of the terms of the lease.

This Federal Law regulates relations dealing with state cadastre registration of immovable property, including plots of land. It shall not be applicable to subsoil. State cadastre data shall be for permanent storage and destruction or removal of the whole database or part thereof shall be prohibited. The Act consists of five Sections divided into 48 articles: (1) general provisions; (2) keeping state cadastre of immovable property; (3) modalities of immovable property registration; (4) qualification for carrying out cadastre activity; (4) conclusive provisions.

Paragraph 4 of the item 6 of the Article 12 of the Federal Law No. 122-FZ on state registration of immovable property and its transactions shall be supplemented with the following wording: “plots of land shall be registered in accordance with cadastre plan.”; Article 25.2 shall be supplemented with the following wording: “The state registration of the ownership right to a plot of land shall be prohibited in such plot of land cannot be allotted in private ownership in accordance with the Federal legislation.” Article 28 of the Federal Law No.

This Act defines standards and rules of conduct for professional engineers, architects and land surveyors.The Act creates a Guam Board of Registration for Professional Engineers, Architects and Land Surveyors which shall administer the provisions of this Act. The professions shall observe the Rules of Conduct promulgated by this Act.

Carinthian Municipality Planning Law.

The present Law lays down provisions relating to land use planning in Carinthia. The Municipal Council is required to adopt a Land Use Zoning Plan which divides the entire municipality into building land, grass land and traffic area taking into consideration the local development plan and the economic, social, ecological and cultural requirements of the whole area. The text consists of 34 articles divided into 4 Parts.

This Law establishes legal basis for geodetic and cartographic activity. The sphere of the aforesaid activity includes distant zoning of the Earth, land use planning and mapping. The Act consists of 3 Sections divided into 21 articles: (1) general provisions; (2) regulation of geodetic and cartographic activity; and (3) conclusive provisions. The competence of the Government shall be to determine the authorized state institution in the sphere of geodesy and cartography. Geodetic, cartographic and hydrographical materials shall form national state geodetic and cartographic fund.

Land Management - Chapter 60 of 21 GCA “Real Property”.

This Chapter provides for the management and other matters of Government land. It consists of 8 Articles divided into sections. Article 1 contains general provisions. The Department of Land Management shall have authority of all government real property for purposes of this Chapter. The Director of Land Management may, when necessary, reserve or set aside government real property not reserved by law for specific public use for the future use of any other department or agency of the government pursuant to section 5.

Regional Law No. 161-OZ “On establishment of land areas and simplified procedure for legalization of land rights”.

This Regional Law establishes simplified procedure for legalization of land rights, envisaging excessive of land dimension that can be inserted in the documentation fixing land rights after land survey practices with more accurate calculation of land area: (a) for gardening 0,06 ha; (b) for horticulture and vegetable growing – 0,06 ha; and (c) for subsistence farming – 0,06 ha.

Regional Law No. 38-Z “On regional land-use planning scheme”.

This Regional Law regulates relations in the sphere of elaboration, composition and the modalities of realization of regional land-use planning with the consideration of sustainable development of territory, distribution of protected areas and mapping of the boundaries of agricultural land. Decision of elaboration of regional land-use planning scheme shall be made by the regional administration.

La présent loi met en exécution la loi cantonale du 23 janvier 1987 concernant l'application de la loi fédérale sur l'aménagement du territoire du 22 juin 1979. Notamment, l’article 1er établit que la présente loi règle la procédure relative au remembrement et à la rectification de limites. Le remembrement consiste en la mise en commun de biens-fonds d'un territoire déterminé et en la redistribution équitable de la propriété et des autres droits réels qui y sont liés.
