Survey Co-ordination Act 1949.

The Act (22 sections) provides for the coordination of surveys and the establishment of a central plan office at the Department of Lands for the recording of surveys, plans and related information. To this end, the Surveyor-General is given powers to ensure coordination of surveys and the Act, and a central plan register is established. Public authorities are to give notice of intention to commence new surveys to the Surveyor-General. The Surveyor-General shall have the power to require connection of proposed surveys to existing surveys, permanent marks etc.

The Act (5 sections, 1 Schedule) sets out the official marks to be used by Government licensed or appointed surveyors in the conduct of official surveys. The use of the marks except in the conduct of an official survey is prohibited and liable to a penalty. Penalties for unauthorized defacement or destruction of survey marks, landmarks or beacons are also provided.

This Act makes provision for authorization of the central Government to granted to municipalities to organize municipal land survey offices and for operations of such offices. Section 2 specifies requirements that municipalities and the land survey offices shall meet in order to qualify for authorization. Application for authorization shall be submitted to the Central Land Survey Agency. The municipal land survey offices shall carry out land survey and registration of immovable property within municipal borders (sect. 5).

The above-mentioned Act establishes that the boundary between British Columbia and Alberta consists of the conventional boundary line and the sinuous boundary line as those lines existed on September 25, 1989, and as they are altered from time to time under section 43 of the Constitution Act, 1982. However, a Boundary Commission may be appointed to review the existing boundaries. Part 2 deals with boundaries between British Columbia, Yukon and Northwest Territories. The State registration of rights to land shall form an integrated part of the land cadaster. Registration shall be carried nation-wide by the State Land Management Department and be managed by a Chief Registrar. A Zone Registrar shall manage registration in a specified zone. Powers of a Registrar are set out in article 7. Documents relative to land shall be registered within thirty days of their creation (art. 8). The Registrar may order registration under article 9.
