Regional Law No. 6-RZ amending Regional Law No. 17-RZ “On governance of public property”.

Article 8.1 shall be amended to add the following wording: “Regional Government shall exercise the following plenary powers: (a) governance of regional public land; (b) allotment of land plots pertaining to regional property free of charge in ownership or in open-ended hereditary possession or tenancy; (c) land valuation for the purpose of conclusion of purchase and sale contracts; (d) establishment of land lease fees; (e) establishment of servitude fees and establishment of public servitude; and (f) validation of average cadastre value of land”.

Regional Law No. 32-ZKO “On establishment of purchase price of plots of land (without construction and edifices thereon) within urban areas destined for agricultural production.

This Regional Law establishes that the prices of plots of urban land destined for agricultural production in ownership by agricultural organizations or peasant farms allotted thereto on condition of permanent (open-ended) land tenure or as life-long hereditary possession shall be established with 15 percent reduction in relation to its cadastre value.

Regional Law No. 69-ZKO amending Regional Law No. 74-ZKO “On allotment of land in ownership free of charge to some categories of citizens”.

Article 5 shall be amended to add the following wording: “Decision on allotment of a plot of land free of charge in ownership to citizens must specify cadastre number, location, land area and authorized land tenure”.

Article 16 shall be amended to add the following wording: «State registration of rights shall be performed in accordance with the request of legal holder of rights, parties to a contract, or authorized person thereby in the presence of notarially certified power of attorney, if not otherwise envisaged by the law, and also at request of judicial bailiff-executor».

Article 87 shall be amended to add the following wording: “Legal holders of the plots of land inserted within the boundaries of areas with particular terms of land tenure must be informed of use restrictions related to the aforesaid land plots within 15 days from the date of insertion in state land cadastre of data on establishment of such area in accordance with the modalities set forth by the Government of the Russian Federation”.

This Regional Law regulates relations concerning turnover of agricultural land within plenary powers pertaining to the jurisdictional competence of the regional administration. Agricultural organizations and peasant farms having agricultural land plots on condition of permanent (open-ended) or hereditary tenancy shall be granted the right of purchase in ownership thereof at the price of 5 percent of cadastre value of the aforesaid agricultural land plots.

This Regional Law regulates relations concerning turnover of agricultural land, including land shares in common property, within plenary powers pertaining to the jurisdictional competence of the regional administration. Only agricultural land plots that have passed cadastre registration shall be authorized for purchase and sale. Local government shall have preferential terms for purchase of agricultural land in case of sale thereof at face value, except for sale through public tenders and except for expropriation of land plots for public and municipal needs.

La presente Ley modifica la Ley Hipotecaria aprobada por Decreto de 8 de febrero de 1946, y la Ley de Catastro Inmobiliario, cuyo texto refundido fue aprobado por Real Decreto Legislativo Nº 1/2004, en relación a la necesidad de resolver las duplicidades administrativas entre el Catastro Inmobiliario y el Registro de la Propiedad, que son instituciones de naturaleza y competencias diferenciadas que, no obstante, recaen sobre un mismo ámbito: la realidad inmobiliaria.

The present Law lays down provisions relating to land use planning and construction in the Canton of Lucerne. Article 2 establishes that the competent authorities shall take into account principles of the federal legislation.
