This Decree prohibits tree logging within certain areas in the State of São Paulo. It consists of 21 articles establishing the zones (including protected zones, natural reserves and urban areas) in which tree logging is prohibited in order to preserve natural habitats. A list of protected trees is specified in article 16. Exceptional tree logging may be authorized by the Environmental Secretariat and the State Forestry Institution.

These Regulations impose upon local authorities involved in free economic zones the duty: (a) to carry out assessment of the impact on the environment of activities in the zones; (b) improve the zones through land use planning; (c) specify obligations of the contracting parties in economic contracts. The local authorities may formulate local supplementary environmental standards. Article 6 requires foreign enterprises to employ environmentally friendly technology. Article 9 deals with permits for the discharge of polluting substances. (13 articles)

The District Council may declare any area a prohibited or preserved (area). All areas listed in the First Schedule are hereby declared preserved areas (by-law 3). No person shall cultivate, cut any grass, or graze animals in any preserved area (by-law 4). The Council shall, after consultation with the Agricultural Officer, prescribe the type of agricultural or animal husbandry, the type of crops that may be planted and the steps taken to prevent soil erosion and to conserve water in a prescribed area (by-law 5).

This text consists of 6 articles. Article 1 establishes the concept of precinct forests defined as the inland and marine fisheries domain and reserved for fishery productivity. Article 2 subjects the issuing of the land property in the precinct forest to the approval by the Ministry of Agriculture. The conduct of activities such as clearing, chopping, reclaiming or burning is prohibited unless prior authorization of the Ministry of Agriculture has been granted (art. 3).

The Authority may declare any area to be a prohibited area. No person shall set up residence in any part of a Conservation Area without the permission of the Board or the Conservator or settle, cultivate graze in restricted areas, clear land, vegetation, cut trees, set traps or nets, etc. The Conservator is granted powers of inspection such as entry upon land.

The present Regulation enacts section 29 of the Park Act. Section 7 establishes that every person who enters or is in a park, conservancy or recreation area shall, at the request of a park officer or park ranger, provide information about any matter pertaining to the use or occupancy of the park, conservancy or recreation area.

The purpose of these Regulations is to prescribe the form of the notice of the intention of the Minister to make a purchase order in pursuance of section 55 of the Wildlife Act, 1976, in respect of registered land. Section 55 allows the Minister, if he wishes so to purchase land by issuing a purchase order under conditions specified in that section. Regulation 4 concerns procedures for lodging any claim by a person to an interest in the relevant land.

This Regional Law establishes criteria and modalities for classification of land of protected areas of regional significance, modalities of management, conservation and protection thereof. It specifies that the Regional Government shall have the right to establish land categories of protected areas that are not envisaged by the national land legislation.

This Regional Law establishes cases of expropriation, including repayment, of public or municipal land for public and municipal needs. Expropriation shall be performed in the following cases: (a) for public construction in accordance with land-use planning projects; (b) for realization of regional and municipal programs; (c) for conservation of the objects of cultural heritage in public ownership; (d) institution of new or extension of already existing protected areas; and (e) construction and reconstruction of objects partially or completely financed out of regional or local budget.
