El presente Decreto reglamenta parcialmente la Ley Nº 160 de 1994, en lo relativo a la elaboración del avalúo comercial de predios y mejoras que se adquieran para fines de reforma agraria y la intervención de peritos en los procedimientos administrativos agrarios de competencia del Instituto Colombiano de la Reforma Agraria (INCORA). En los procedimientos administrativos de adquisición de tierras y mejoras rurales que adelante directamente el INCORA, se ordenará la realización de un avalúo comercial de los inmuebles y bienes respectivos por parte de un perito.

The necessity of transfer of agricultural land from one type into another is substantiated by natural factors and economic expediency of its further use within the stock of land. The transfer of land can be carried out on request of the land tenant forwarded to a local executive body. The transfer is carried out by the departments of the State Committee on Land and Land Survey. Agricultural land comprises arable land, fallow land, land covered by perennial plantations, hayfields and pastures.

This Regulation is based on article 21 of Act No. 2924 dated 17 October 1983 and sets forth procedures and principles for providing support to forest villagers whose villages would be moved.Villages where development activities could not be achieved in their present locations and those that should be moved due to soil-water regime, health, military purposes, tourism and forestry will be determined jointly by the local organizations of the Ministry of Forestry, Ministry of Agriculture and Rural Affairs, General Directorate of Forestry and General Directorate of Rural Services.

Permits shall be obtained in accordance with a procedural scheme adopted by the Ministry of Agriculture. However acquisition of land for certain (agricultural) purposes is exempted from such requirement. If such is the case the acquirer shall submit a self declaration drawn up in accordance with a scheme adopted by the Ministry of Agriculture. Together with the declaration a statement from the municipal authorities regarding the status ad size of the land shall be submitted.

The text of this Decree of the Department of Agriculture consists of 24 sections divided into 4 Chapters: General introductory provisions (I); Implementation and maintenance (II); Ecological cultivation and ecological cleaning measures (III); Final provisions (IV). The aim of granting incentives for investment is to protect agricultural land, to prevent erosion and pollution of the soil, and to enhance biodiversity and natural beauty. Measures are classified as "technical ecological measures" and "ecological planting and cleaning measures".

El Decreto, que consta de 9 artículos, aprueba el Plan de uso del suelo para el Departamento de Santa Cruz. El plan establece las siguientes categorías generales de uso: a) tierras de uso agropecuario intensivo; b) tierras de uso agropecuario extensivo; c) tierras de uso agrosilvopastoral; d) tierras de uso forestal; e) tierras de uso restringido; e) áreas naturales protegidas (art. 2º).

Every person who desires to undertake a development project must obtain a planning permission from the Authority before undertaking the development (comma. 1 of reg. 5). For purposes of paragraph 1, development projects shall be classified in accordance with paragraph 2 of regulation 5. Each application shall be accompanied by appropriate plans (comma. 1 of reg. 6). An application for a planning permission is not necessary for the development of land for agricultural purposes or for forestry (reg. 8).
