This Act provides the legal framework for the relationship between landlords and tenants, it consists of 89 sections and is divided into four parts. Part I contains general provisions on leases, rents and covenants. Part II is dedicated to the distress for rent and related procedures. Part III concerns “ejectment proceedings liability of tenants overholding” and Part IV contains miscellaneous provisions.

Interpretation and General Provisions Act.

This Act makes provision for general matters relating to written law in Kenya and contains interpretations of words and expressions used in written law in Kenya.This Act shall not apply for purposes of the construction or interpretation of the Constitution. The Constitution is not a written law for the purposes of this Act.

Protection of Tenants (Special Provisions) (Amendment) Act.

The amendments include changes to provisions concerning damage to premises or amenities and the Common Amenities Board. Where the Commissioner directs the Common Amenities Board shall repair any damage to any premises or restore and repair any facility that was previously provided for the tenant.

Transfer of Property Tax (Amendment) Act.

There are several amendments to provisions that concern the Tax on Transfer of Property Act. Persons that are not citizens of Sri Lanka must sign a declaration in the instrument of transfer effecting that they are non-citizens (sect. 2). There are further amendments concerning offences (sect. 3).

Land Acquisition (Amendment) Act (No. 13 of 1986).

This Act amends the Land Acquisition Act that establishes the procedure to be followed by the competent authorities for the acquisition of land for public purposes. Section 45 of the Land Acquisition Act is amended as the acquiring officer shall tender and make payment of compensation in respect of acquisitioned land taking into consideration the market value of the land (sect. 2).

This Act amends the Land Acquistion Act which establishes the procedure to be followed by the competent authorities for the acquisition of land for public purpose. Section 17 is amended concerning persons entitled to compensation. The Acquiring officer shall pay the sum on the certificate issued by the Commissioner of Labour.

Land Development (Amendment) Act.

This Act amends the Land Development Ordinance and repeals the Sale of State Land (Special Provisions) Law. There are amendments relating to the definitions of terms used within the Act. Section 8 concerns purposes for which State Land may be mapped out including the prevention of erosion from the soil and the protection, conservation and development needs of the area (sect. 8). There are extensive provisions relating to the manner of alienation of State Land including the need for a permit to occupy the land (sect. 19).

The Act makes provision for the registration of title in land and related matters. The Act also defines characteristics of various rights in land, sets out the effects of registration if title in land and provides for the acquisition of land by prescription.As for the administration of land registration, there shall be land registry offices and officers for each registration district. The Act also concerns co-proprietorship and partition.

La présente loi est relative aux levées topographiques et cadastrales. Notamment, les travaux de la carte et l'établissement du cadastre sont confiés au Service de l'aménagement du territoire. L’article 2 établit que tout propriétaire foncier est tenu de céder le terrain nécessaire à la conservation et à l'utilisation d'un point trigonométrique de cette espèce, ainsi que le droit d'y accéder, et cela soit par aliénation, soit par l'établissement d'une servitude, le tout moyennant indemnité complète. Le texte comprend 9 articles.

Decree-Law No. 38/83 regulating rural land leasing contracts.

In compliance with Act No. 15/II/82 (art. 1, para. 5) of 26 March, and with article 75, paragraph 1, point (f) of the Constitution, the Government of Cape Verde regulates the rural leasing contracts for lands not subject to expropriation, according to the Agricultural Reform Act. It also regulates rural sharecropping and rural land leasing which remain temporarily in force in compliance with articles 9 and 23 of the aforementioned Act. This Decree-Law is divided into 9 chapters concerning conditions, terms and requirements for obtaining such leasing contracts.
