This Ministerial Decree regulates timber extraction on urban land pertaining to forest estate, including urban forests. Citizens who have been allotted plots of urban land as lifelong hereditary estate, usufruct, ownership or lease shall have the right to cut trees and shrubbery thereon without any prior authorization of the local self-government except for cases envisaged by the legislation. Legal and natural persons who have caused in the process of cutting illegal damage to other plant or forest species or growing conditions thereof shall be liable for compensation of damages.

It is provided by section 3 of the National Lands Act that the Minister may, by directions in writing delegate any of his functions in connection with the National Lands Act to the Commissioner of Lands and Survey or any other Senior Officer of the Ministry responsible for Lands, the power to sign Lease Fiats and to grant permission to mortgage leasehold interest in residential lots is hereby delegated to the Principal Lands Officer and the National Estate Section. There shall be paid by every lessee of national land a transfer fee at specified rates on the value of the development or improvement done on the leasehold or of the amount of the consideration whichever is greater, in respect of every transfer of subletting of lease outside the compulsory registration areas declared as such under the Registered Land Act.

Rules to implement provisions of the National Lands Act. Except in special cases approved by the Minister, national lands, other than town or village lots, will be disposed of only by way of grants. All mines of gold and silver and other metals and minerals, all ancient monuments, mounds or relics within the meaning of section 12 of the National Lands Act and all forest produce are strictly reserved and do not pass under the grant nor lease.

This Decree prescribes the implementation of the Land Law of 2003. It deals with the following matters: land price-determining methods, price brackets for assorted land categories; land use levy and land rent collection; compensation, support, resettlement when the State recovers land for use of defence or security purposes, for national interests, public interests, economic development; land inspection; sanctioning of administrative violations.

This Order makes modifications of the following enactments which appear to be necessary or expedient in consequence of the Title Conditions (Scotland) Act 2003: Lands Clauses Consolidation (Scotland) Act 1845; Abolition of Feudal Tenure etc (Scotland) Act 2000; Housing (Forms) (Scotland) Regulations 1974; Town and Country Planning (Control of Advertisements) (Scotland) Regulations 1984; Compulsory Purchase by Public Authorities (Inquiries Procedure) (Scotland) Rules 1998.

The present Regulation enacts certain sections of the Quarriable Substances Act (SNB 1991, c Q-1.1). The text – consisting of 28 sections – deals, inter alia, with the following aspects: shore areas, quarry permit, quarry lease, peat exploration licence, peat lease, written authorization, renewal of quarry lease or peat lease, fee for transfer of quarry lease or peat lease, protection, reclamation and rehabilitation.

This Ministerial Decree validates the Regulation on allotment in lease and management of pastures, the form of contract on lease of the pasture areas for stockbreeding purpose, lease of pasture areas for other purposes, form of forest land plot usage permit for silvopastoralism. Pasture areas allotted before 16 June 1999 for long-term use shall remain in use of the lessees until 2025. Lessee shall have the right to use waterbodies in accordance with the established limits.

The Ministerial Decree regards allotment in lease of agricultural land pertaining to the Special Fund of consisting of agricultural land (except for pastures) pertaining to public property. Allotment of the public agricultural land shall be carried out through tender. The winner of tender shall acquire the right to conclude lease contract in accordance with the terms and conditions of tender within ten days from conclusion of tender and legalization of its outcome.

The present Decree establishes rules as to expropriation and concession of the plots of land of all categories irrespectively of the kind of land tenure, lifelong hereditary possession, private ownership or lease. The plots of land shall be allotted in conformity with the project of the appropriate allotment thereof. Legal persons, natural persons and citizens interested in the allotment of the plots of land for agricultural commodity production, farming, and subsidiary small-holding, mowing and grazing must submit an application to the local self-government.

The Regulation consists of 7 Sections composed of 120 issues dealing with the following matters: 1) general provisions (sect. 1, issues 1-14); 2) preparatory work (sect. 2, issues 15-29); 3) designing project – projecting (sect. 3, issues 30-103); 4) examination and validation of the project (sect. 4, issues 104-109); 5) projecting on site (sect. 5, issues 110-115); 6) mapping (sect. 6, issues 116-118); 7) technical assistance in the implementation of the project (sect. 7, issues 119-120).
