Crown Lands Regulations.

Applications for the lease of, or the purchase of Crown lands shall be made to the Commissioner in Castries according to the form to be obtained at that office and shall be clearly indicated the boundaries of such land. The Commissioner shall, after examination, forward the application to the Agricultural Superintendent. Applications shall not be approved normally if the land is more than one thousand feet over sea level, is near a river or stream, is located on a hill or in a forest that should be conserved, is required for an allotment garden, etc.

Amendments of the principal Regulations concern meetings of the Land Committee, appeals under regulation 6, inheritance, the processing of a notice given under regulation 7 or a notice given under regulation 9 (1)(b), rates and fees, development charges, tender premiums, limitation on area or residential lease and land.

These Regulations concern enforcement of payment of service levy imposed under section 5 of the State Land Act. The enforcement action may be taken on specified default (reg. 3). A Notice shall be issued on the occupier who defaults on a loan. The occupier may contest the Notice of default. The property of the defaulting occupier may be sold so as recover any defaulted payments. The Regulations also provide for an action of repossession of the plot of State land of the defaulting occupier. Procedures for such repossession are set out in regulations 6 and 8.

Registered Land (Registration of Maximum Number of Proprietors) Rules (Cap. 300).

These Rules prescribe that only twenty or any lesser number of persons may be registered as the proprietors of any land, lease or charge where charge to the land restricts its user to any purpose other than agriculture and in the opinion of the registrar, the instrument presented for registration will have the effect of vesting the land, lease or charge in such persons jointly as partnership property. The Rules shall only apply to specified registration sections.

Land Tenants (Security of Tenure) (Rent Review) Regulations (Cap. 59:54).

These Regulations make provision for the review of rent by Rent Assessment Boards. An application for review of rent may be made pursuant to section 5a of the Act to a Rent Assessment Board, constituted under the Rent Restriction Act, having jurisdiction over the area within which the land is located (reg. 3). The application shall be in the form prescribed by these Regulations and set out in the Schedule. A hearing shall be held, and upon decision of the Board, a certificate shall be issued to the applicant. (8 regulations completed by a Schedule)

Land Tenants (Security of Tenure)(Rent Review) Order (Cap. 59:54).

A review of rent may be made pursuant to section 5a of the Land Tenants (Security of Tenure) Act to a Rent assessment Board, constituted under the Rent Restriction Act, having jurisdiction over the area within which the land is located. This Order specifies the matters of which a Board shall take cognisance in undertaking a review.

These Regulations prescribe forms for purposes of the Land Tenants (Security of Tenure) Act and provide that a landlord or a tenant may require a written memorandum of statutory lease in case of continuance of such lease. A memorandum of lease shall be in the form as prescribed in the Schedule to these Regulations and non-fulfilment of the requirements shall constitute an offence. Forms in the Schedule include also: a tenant's or landlord's notice and notification under section 9 of the Act; a tenant's notice under section 4 of the Act.

Agricultural Small Holdings Tenure Regulations (Cap. 59:53).

These Regulations prescribe forms for purposes of the Agricultural Small Holdings Tenure Act. Forms include: a tenancy instrument required by section 5 of the Act; a receipt issued under section 6 of the Act; an application made by a tenant or landlord to the Agricultural Tribunal under section 22 of the Act; a notice of the Tribunal's intention to inspect a small holding given under section 30 of the Act; a notice of appeal required under section 36 of the Act; and an application by a landlord for possession of a small holding or ejectment of a tenant.

This Order implements provisions of the Agricultural Small Holdings Tenure Act by establishing three Agricultural Tribunals. Section 12 of the Act grants powers to the President to establish tribunals which shall carry out functions assigned to them under section 20 of the Act in respect of their district of jurisdiction.
