The present Regulation lays down provisions relating to the alienation and leasing of agricultural lands in the domain of the State. In particular, it applies to the alienation and leasing of ungranted land, except land designated for blueberry production.

Its particular purpose is to determine the conditions under which the Minister of the environment is authorized to grant the alienation, lease or occupation of the property and to agree on the limits of such property. This Ministerial Decree establishes the rules for state registration of rights and encumbrances to immovable property and transactions therewith. The following rights and encumbrances shall be subject to mandatory state registration: (a) ownership; (b) tenancy; (c) mortgage and encumbrances originating therefrom; (d) lease and sub-lease for the period of three years and over; (e) servitude; (f) use restrictions; (g) court decisions; (h) nature management activities listed by the Government; and (i) open-ended land tenure.

This Order makes amendments to the Agricultural Holdings (Scotland) Act 2003 so as to make it compatible with a specified human right. It inserts a new section (section 72A) into the 2003 Act. That section provides that section 73 applies to a tenancy continuing to have effect by virtue of section 72(6) unless the tenancy is a relevant tenancy

This Order provides with respect to an application for a determination regarding the registration notices and agreements in the Land Register of Scotland. Notices and agreements rejected by the Keeper of the Registers of Scotland can be registered following a determination by the Court of Session, the sheriff court or the Lands Tribunal for Scotland that they are registrable. A determination may be sought in respect of notices and agreements specified by this Order.

This Order prescribes forms for notices required to implement the conversion of ultra-long leases to ownership under the Long Leases (Scotland) Act 2012. They concern, among other things: conversion of reserved sporting rights and conversion of qualifying condition into a climate change burden or a conservation burden.

The present Regulations are made under the Crown Minerals Act. In particular, the Regulations lay down provisions relating to the orderly exploitation of minerals in Saskatchewan. Section 3 establishes that the Regulations apply to all Crown minerals other than any Crown minerals listed in this section.

These Regulations prescribe terms, set out in Schedule 1, as to the maintenance, repair and insurance of fixed equipment which are deemed to be incorporated in every contract of tenancy of an agricultural holding except where they would impose on one of the parties to a written agreement a liability which under the agreement is imposed on the other. They divides between the landlord and the tenant of a holding the responsibility for maintaining, repairing and insuring fixed equipment, and imposes upon each party certain specific liabilities in regard to those matters.

Areas of public forest and pasture maybe leased to public or private entities through public biddings. The designated bodies for examining and approving the awards, rules of procedure, and the type of activities allowed on these areas are provided for in the Instruction.

This Order amends the Lands Clauses Act in section 98 so as to amend the monetary jurisdictional level of Resident Magistrates Courts. Section 98 allows the jurisdiction given by this Act to the Supreme Court and to a Judge thereof in respect of money paid into the Treasury under this Act, to be exercised by any Resident Magistrate’s Court if such money does not exceed a specified amount.
