Land Titles (Strata) Act (Amendment of Fourth Schedule) Order 2004, No. S 243.

The Act has been amended as per the deletion and substitution of paragraph 1 and the insertion of a new paragraph 1A; paragraph 2, 3 and 4 underwent minor changes in terms of substitution of sentences and some additions. Any application made or pending and any order or decision of and any right of appeal of a Strata Titles Board prior to 1st May 2004 shall not be affected.

Chapter 4 of Title 67 of the Trust Territory Code - Subdivision of Public Land.

This Chapter lays down rules relative to the division of public lands. It specifies powers and duties of the Chief of Lands and Surveys regarding the subdivision of public land and in particular lands that are adjacent to the sea or tidal areas. Reasonable public access shall be secured in public areas to be subdivided or offered for sale.

Notamment, l’article 1er établit que la présente loi a pour but d’assurer l’acquisition, la gestion, la mise à jour et la diffusion des données de la mensuration officielle sur l’ensemble du territoire cantonal. Le texte comprend 120 articles répartis en 4 titres comme suit: Dispositions générales (Ier); La nouvelle mensuration parcellaire (II); Conservation (III); Dispositions transitoires et finales (IV).

The Developer shall, before lodging a survey plan for the development area with the Surveyor-General, prepare a lot plan in accordance with this section (sect. 3). A schedule of lot entitlements for the purposes of this Act shall be prepared by a valuer as defined in the Valuation of Land Act (sect. 5). The Registrar-General shall, at the time of creating a folio of the Register under the Real Property Act in respect of a lot, record on the Register and the certificate as to title in relation to the lot (sect. 6).

The Act provides for the establishment of a town planning board, which shall exercise the following functions: (a) to advise the Minister in matters relating to the preparation and carrying into effect of town planning schemes; (b) to encourage the study of town planning: (c) to advise and assist local authorities generally in connection with town planning schemes and the layout of new township.

This Act provides rules relative to the survey of land. consists of 49 sections which are divided into 9 Parts: Preliminary (I); Administration (II); Recognition and Duties of Land Surveyors (III); Original Surveys and Re-surveys (IV); Division Surveys (V); Townships (VI); Beacons and Boundaries (VII); General Plans and Diagrams (VIII); Miscellaneous (IX).At Harare a Surveyor-General's Office is established (sect. 7). A Survey Regulations Board is established under section 8. The Board may make Regulations, with approval of the Minister, prescribing matters specified in section 9.

Regional Act No. 33 making provision in matter of land reclamation.

The Basilicata Region promotes and arranges a general land reclamation scheme in order to provide for the territorial maintenance, the rational exploitation of water resources, soil conservation, agricultural development and improvement of agricultural production. The Region shall elaborate directives so as to plan the interventions to be undertaken by safeguarding at the same time the rural environment. With a view to implementing the land reclamation plans, the regional territory devoted to the said land reclamation shall be divided into different territorial areas (art. 3).

National Land Code (Amendment) Act 2001

The present Act lays down provisions to amend and supplement the National Land Code. First of all, section 2 provides for the amendment of the long title of the National Land Code: the words “Selangor and Trengganu”are hereby replaced by the words “Selangor, Terengganu and the Federal Territory of Kuala Lumpur”. The same amendment is laid down to the Preamble. Further linguistic amendments concern the names of official authorities and institutions (section 4). Moreover, the Act lays down amendments dealing with the application related to estate lands.

Regional Law No. 49-z on concession free-of-charge to the citizens of the plots of public or municipal land.

Except for cases envisaged by the Land Code and federal laws, citizens actually having in use plots of land for personal housing construction and exploitation of individual housing facilities, pertaining to public or municipal property, and having used them till the adoption of the Land Code, have the right to a single acquisition of free-of-charge of the plots of land on condition of property.

Subdivision Act 2002.

This Act makes provision for the subdivision of land under Part 5 of the Planning Act 2002 and related matters such as the making of subdivision plans and the registration of subdivisions. The Act sets out requirements for a subdivision development application in addition to the requirements set out in Division 1 of Part 5 of the Planning Act 2002. The Registrar of Titles shall not register a subdivision or amalgamation of land without a written notice from the Chief Executive Officer stating approval and fulfilment of other conditions. The Act also provides for review of decisions.

Land reserves in the Republic of Kazakhstan shall be divided in accordance with their designated purpose into the following categories: 1) lands of agricultural designation; 2) lands of residential areas (cities, towns, settlements and rural residential areas); 3) lands used for industry, transport, communications, defence and other non-agricultural purposes; 4) lands of specially protected territories, lands of health rehabilitating, recreational, historical and cultural designation; 5) lands of the forest reserve; 6) lands of the forest reserve; 7) lands of the reserve.
