Location

Montserrat

English and Irish colonists from St. Kitts first settled on Montserrat in 1632; the first African slaves arrived three decades later. The British and French fought for possession of the island for most of the 18th century, but it finally was confirmed as a British possession in 1783. The island's sugar plantation economy was converted to small farm landholdings in the mid-19th century. Much of this island was devastated and two-thirds of the population fled abroad because of the eruption of the Soufriere Hills Volcano that began on 18 July 1995. Montserrat has endured volcanic activity since, with the last eruption occurring in July 2003.


Montserrat is a parliamentary democracy and a self-governing overseas territory of the UK.

Crown Title Act (Cap. 8.11).

This Act establishes that any interest in land remaining unclaimed since the coming into force of the Land Adjudication Act, and which by the provisions of section 17(1) of that Act were deemed to be Crown Land, shall, if not claimed by 31 December, 2000, vest in the Crown.

Act to amend the Landholding Control: by deleting “corporation” and “corporations” wherever they appear and substituting “company” and “companies” respectively; by deleting “person belonging to Montserrat” wherever it appears and substituting “Montserratian”; by deleting “person not belonging to Montserrat” and “persons not belonging to Montserrat” wherever they appear and substituting “nonMontserratian” and “non-Montserratians” respectively; and by providing anew with respect to land and mortgages held by nonMontserratians.

Conveyancing and Law of Property Ordinance (Cap. 250).

This Act makes provision with respect to the sale, mortgage, charge, lease, vesting and other conveyancing of property. The Act form and content of contracts, and assigns certain rights to a vendor and purchaser. All conveyances in land shall be by deed in accordance with this Act. Special rules apply to easements, mortgages, leases, and some other tnsfers of rights.

This Act amends various Acts including the Registration and Records Act, the Harbour Master Act and the Agricultural Small Holdings Act. The Registration and Records Act is amended in the Schedule which, pursuant to section 40, prescribes fees for services. The Agricultural Small Holdings Act is amended in section 7, which prescribes stamp duties and fees, and Schedule B, which also prescribes fees for purposes of section 7 (2).

Physical Planning (Amendment) Act, 2012 (No. 12 of 2012)

This Act amends the Physical Planning Act: in section 2 (interpretation); in section 3 by deleting paragraph (h) and substituting the following: “(h) the Managing Director of the Montserrat Utilities Limited (MUL) or a representative nominated by the Managing Director; by inserting section 63A on the sale of products and services by the Chief Physical Planner; in section 64 with respect to fees for the sale of products and services.
