Le présent décret fixe les conditions et les modalités d'autorisation d'usage dans le cadre des dispositions de l'article 35 de la loi nº 84-12 du 23 juin 1984 portant régime général des forêts. L'autorisation d'usage est accordée pour une durée déterminée sur des parcelles délimitées, compatiblement avec la nature des activités de mise en valeur qui y seront mise en oeuvre, et notamment, les activités d'élevage (pépinière, petit élevage, élevage cynégétique), la création de vergers arboricoles et la plantation forestière.

La présente ordonnance complète le dispositif législatif en matière forestière et donne un fondement juridique à l'intervention de l'Office national des forêts (ONF) et aux actes de gestion durable : elle étend l'essentiel du code forestier à la Guyane, avec les adaptations et dispositions spécifiques rendues nécessaires par le contexte et les enjeux particuliers de la forêt guyanaise. The present Act, which is composed of 35 Paragraphs, has been adopted to ensure the development of agriculture and forestry by improving the area structure of farms, forests and forest lands, and by adapting borders of immovable properties to the system of water drainage, roads and terrain features. Integration applies to lands placed in one or several villages or their parts. However, it does not apply to lands where mining or industrial plants, historic or architectural monuments, sanctuaries, lands used for fishery or allocated for special purposes exist.

The Act, which is composed of ten Paragraphs, establishes that forests and forest lands belonging to self-governing authorities become State-owned property. The same applies to agricultural lands registered as planned to become forests. The transfer shall be accepted by the Minister of Forestry and by the Council of the State.

The Regulation of the Minister of Environment, Natural Resources and Forestry, which is composed of five Chapters, establishes that the auction to sale forests, lands or other immovable properties managed by the State Forests, is organized by a special commission which consists of 3 to 7 members. The commission selects the sale method (Chapters 2-4).

This Decree consists of 4 Chapters divided into 18 articles: General provisions (I); Contractual assignment of land for agricultural production (II); Contractual assignment of production forest land (III); Implementation provisions (IV). The objectives of contractual land assignment are to use land and forest resources in order to raise production and business efficiency of State-run agricultural or forestry farms, to create more jobs and increase incomes, etc.

This Act makes provision, in 22 Chapters, for the management and conservation of forest resources of Liberia, defines ownership rights and other rights in forests, provides for the protection of the environment and wildlife in forests, regulates the trade in forest products and provides for various other matters relative to forestry and wildlife.Chapter 2 defines rights in forest resources in Liberia and grants the right to the Forestry Development Authority to lease out forestry land.
