These Regulations, made under section 77 of the Agricultural (Commercial) Land Reform Act, establish the form application for the consent of the Minister of Lands, Resettlement and Rehabilitation in terms of section 58 of the Agricultural (Commercial) Land Reform Act, 1995 (consent to Acquire Agricultural Land or to enter into an Agreement for Occupation or Possession of Agricultural Land by Foreign National).

The purpose of the present Law is to safeguard the public interest on the occasion of the transfer of land or parts thereof, taking into account the need to comply with the principles of a sustainable protection of the environment, nature and landscape.

These Regulations are enacted in order to strengthen the protection, management, construction and rational development and utilization of .

The document contains classification list of the stock of land by categories and economic significance areas. The stock of land is subdivided into the following categories and areas of economic significance: 1. agricultural land; 2. urban land; 3. industrial land and non-agricultural land; 4. environmental protection land, recreational land and land pertaining to cultural heritage; 5. forest land; 6. land pertaining to the stock of water; 7. reserve land.

The purpose of these Regulations is to protect and improve agricultural environment, prevent and control agricultural environmental pollution and ecological destruction, rationally develop and utilize agricultural natural resources. The Regulations consist of 37 Articles divided into 5 chapters: General provisions; Supervision and administration; Measures for protection, prevention and control; Legal liabilities; Supplementary provisions.

The Agricultural Perspective Plan (APP) is a national strategy with a cross-sectoral approach with a duration of twenty years (1995-2015). Its goal is to add two percentage points to the country’s agricultural growth which would expand per capita agricultural growth sixfold, from its current 0.5% to 3% per year. The APP strategy is based on the acceleration of the agricultural growth rate sufficiently to obtrain strong multiplier effect on growth in employment, both in agriculture itself and in nonagricultural sectors.

With a view to protect and improve the agricultural environment, to prevent pollution and protect ecosystem, the Regulations are formulated. The agricultural environment is defined as including land, water for agricultural purposes, air and other factors which have an impact on the survival and development of agricultural resources.The purpose of these Regulations is to protect and improve agricultural environment, prevent and control agricultural environmental pollution and ecological destruction, rationally develop and utilize agricultural natural resources.

The purpose of this Act is to contribute to the strengthening of the agricultural competitiveness, the balanced development of the national economy, and the preservation of the environment of national land through the stabilization of farmers' management and the improvement of productivity, by stipulating necessary matters for the ownership, utilization, preservation, etc. of farmland in order to utilize and manage farmland efficiently.
