The Act sets out a series of measures which are designed to conserve biodiversity and to protect and enhance the biological and geological natural heritage of Scotland. In doing so, the Act provides the principal legislative components of a new, integrated, system for nature conservation within Scotland. The Act also locates the conservation of biodiversity and of Scotland's natural environment within a wider British, European and global context.

These Regulations further implement in Scotland the requirements of Council Directive 91/676/EEC concerning the protection of waters against pollution caused by nitrates from agricultural sources. The objective of the Directive is to ensure that measures are taken to reduce and prevent nitrate pollution from agricultural sources. It provides a framework for action to reduce nitrate levels in the catchments of rivers and groundwater sources affected by such pollution, and to reduce eutrophication of freshwater bodies, estuaries, and coastal waters.

These Regulations amend the Nitrate Pollution Prevention Regulations 2008 so as to provide for revised designations of areas of land in England identified as nitrate vulnerable zones for the purposes of Council Directive 91/676/EEC concerning the protection of waters against pollution caused by nitrates from agricultural sources.

The Ninth Development Plan is a national plan with a sectoral approach covering the period 2007–2013. The main objectives of the Plan are: a) increasing competitiveness, b) increasing employment, c) strengthening human development and social solidarity, d) ensuring regional development, e) increasing quality and effectiveness in public services. By establishing an action programme for nitrate vulnerable zones these Regulation implement, as regards England and Wales, the requirement in this respect as laid down in article 5 of Council Directive 91/676/EC concerning the protection of waters against pollution by nitrates from agricultural sources. This Decree of the Ministry of Environment provides for the communication of projects and operations which may cause acute or substantial pollution problems. All operations listed in section 3 shall be communicated to the State Pollution Supervision and Control Agency. They include production of pesticides and chemical fertilizer (urea).
