El presente Decreto establece las norma para la confección del Catastro Territorial de la Provincia y el procedimiento técnico que debe seguir la Dirección General de Catastro. Las normas tienen por objeto tanto las tierras urbanas como rurales. El Decreto se compone de los siguientes Títulos : I) Confección de Registros Catastrales ; II) Conservación del Catastro ; III) Empadronamiento impositivo ; IV) Valuación de las parcelas urbanas ; V) Valuaciones rurales ; VI) Obligaciones y sanciones ; VII) Reclamaciones ; VIII) Descentralización ; IX) Disposiciones generales

The present Law implements the Federal Land Parcel Act of 2 August 1961 (BGBl. I, pp. 1091-1103) and Land Lease Act of 8 November 1985 (BGBl. I p. 2075). In particular, the Law lays down provisions dealing with registration, proceedings and authorization of land transactions. The text consists of 7 articles and 1 Annex.

The present Act lays down provisions relating to the determination, levying and payment of property tax. The text consists of 46 articles divided into 6 Parts as follows: Tax liability (I); Calculation of land lax (II); Determination and payment of land tax (III); Remission of land tax (IV); Transitional and final provisions (V); Land tax under article 3 of the German Unification Treaty (VI).

The present Ordinance implements, inter alia, the Computerized Land Register Ordinance in its version of 24 January 1995. In particular, the Ordinance lays down provisions relating to the correct registration of mining property. This Ministerial Decree establishes the modalities of conducting inventory of public land fund with a view of ensuring reliability of land survey and mapping data with the insertion of modifications and changes in land areas, distribution of land by categories irrespectively of the form of ownership. All land areas within the national boundaries of the Kyrgyz Republic, constituting national land fund, shall be subject to inventory.

Article 8 shall be amended to add the following wording: “after the wording purchase and sale shall be inserted the wording donation”.

This Law establishes legal basis, terms and conditions of transfer of land from one category to another. Transfer of land shall be state (public) function and shall be performed in accordance with purposeful use of land in case of modification of main purposeful use. Category and type of land area shall be specified in: (a) acts of local self-government related to allocation or concession of land; (b) in land-related contracts; (c) in land cadastre documentation; and (d) in land certificates.

Article 24 shall be amended to add the following wording: “Data related to registered rights can be released from the Unified Information System on Immovable Property through Internet in accordance with the modalities set forth by the Government”.

This Ministerial Decree establishes the modalities of land valuation with a view of establishment of the cost of forest land for the purpose of compensation of damages in case of use of plots of forest land for purpose not related to forestry and, in particular due to land expropriation, provisional land occupation or restriction of land ownership rights of forest land plots. Cadastre valuation shall be performed in relation to: (a) forest land plots without edifices, roads and vegetation; and (b) forest stand growing on a plot of forest land.
