Physical Planning and Development Control Act (No. 25 of 2002).

This Act provides rules relative to the physical development of public and private land in Grenada so as to, among other things: ensure sustainable land use; maintain and improve the quality of the physical environment; provide for the orderly subdivision of land; and protect and conserve the natural and cultural heritage of Grenada.As for the administration of this Act, the Development Control Authority established by the Land Development Control Act, is continued as the Panning and Development Authority.

This Act provides for the establishment of the Development and Planning Corporation, defines powers and functions of the Corporation and makes provisions in relation with tax incentives for development.The Corporation shall be responsible for physical planning in Dominica. It shall have the power to carry out or secure the laying out and development of designated areas.The Corporation shall have also various powers in respect of dealings in land such as acquisition, sale or lease.

This Implementing Regulation is composed of 32 articles. Article 1 gives terms and definitions. Article 2 charges the Committee of Industrial Zones Affairs to propose and define areas and sites for the establishment of industries. Articles 3 to 5 define competencies of the Department of Industrial Zones, in particular to: divide industrial zones by the cooperation with Physical Planning Department and with the Environment Apparatus; prepare maps; and, keep a register for industrial zones.

Resolution No. 302 of 1988 redefining requirements and conditions for obtaining licences for the division of lands destined to construction or reconstruction.

This Resolution is composed of 9 articles. Article 1 decrees the ban on the division of lands intended to the construction or reconstruction before obtaining licences from the Ministry of Housing. Article 2 specifies documents and certificates necessary for submitting applications to the department of Physical Training. Article 3 classifies lands subjected to the division in tree categories: lands situated in zones with accredited and adopted detail planes; lands situated in zones with general planes; and, lands situated outside of planned zones. Article 5 defines obligations of licensees.

This Resolution is composed of 7 Chapters divided into 34 articles. Chapter I gives terms and definitions. Chapter II deals with the establishment of industrial zones, in particular: establishment and definition of industrial zones shall be carried out by a resolution of the Prime Minister; industrial zones are divided into branches industrial zones and branches into sub-branches; maps; industrial activities shall start within a year from the date of the receipt of land vouchers; and, keeping of land registers. Chapter III pertains to the exploitation of lands destined to industrial zones.

This Act concerns the management of lands within a radius of two miles beyond the municipal boundaries of the city of Roseau (“controlled lands”). No sale or transfer of controlled lands, or any dealing in any right, estate or interest in such lands, or any agreement for the same, shall be of effect in law or equity without the approval of the Development and Planning Corporation. Construction of buildings on controlled lands requires a licence granted for the purpose by the Central Housing and Planning Authority.

These Regulations implement provisions of the Land Development and Utilization Act and concern, among other things: registration on the register as mentioned in section 2 of the Act; appeal against an Order made under subsection (1) of section 5 of the Act; information to be provided to the Minister on any sale of agricultural land or to any grant, assignment or surrender of a tenancy of such land for an interest not less than that of a tenancy for a year; and representations to the Land Development and Utilization Commission.

Il est institué sur le territoire de la République d'Haïti, à proximité des ports et aéroports, des zones clôturées dénommées parcs industriels, dotés de facilités propres à leur fonctionnement. L'État haïtien concède à la Société d'Équipement National (SEN) le privilège exclusif d'organiser, de gérer et d'administrer les parcs industriels. Les industries autorisées à s'installer dans un parc sndustriel peuvent bénéficier d'avantages et d'exonérations fiscales.

This Act grants power to the Minister to declare an area to be a project area, so as to facilitate cadastral mapping and tenure clarification of that area, to exempt certain land from restrictions imposed by the Local Improvements Act, the Natural Resources Conservation Authority Act and the Town and Country Planning Act and to grant other exemptions regarding land registration and land tax.
