Land Control Regulations (Cap. 302).

These Regulations implement provisions of the Land Control Act with respect to (an application for) consent to a controlled transaction, to (an application for) exemption under section 24 of the Act and an appeal to the central land control appeals board or a provincial land control appeals board. The application for consent to a controlled transaction shall be in Form 1 in the Schedule.

This Act lays down various basic principles of ownership including joint ownership and condominium ownership, and real rights on another's property, and defines some other legal notions such as possession of property and holding of property. The status of all state- and municipally-owned objects shall be determined by way of separate acts. The transfer of the right of ownership or the creation of another real right over immovable property which is state- or municipally-owned shall be done in writing. The notarial form shall not be required.

Law on denationalization and privatization of state-owned property in the Republic of Belarus.

The objects of privatization shall be the following: state-owned and public dwellings; state-owned enterprises, institutions, organizations, structural units of associations and structural subdivisions of enterprises; state-owned property, provided into lease; portions (allotments, shares) belonging to the Republic of Belarus and to administrative and territorial units in the property of managing subjects.

This Law makes provision for the payment of the use of land in the form of land tax and lease fees. The rates of land tax are established in article 2. Land tax shall be established on cadastrial documentation and be imposed on land users who are manufacturing agricultural products. Payment shall also be made for land not used for agriculture. Categories of users specified in article 9 are exempted fromthe payment of land tax. They include "dehkan", private farms during three years or one year depending upon the type of land.

Regulation on the order of transfer of lands from one category into another and the transfer of less productive lands into unproductive.

This Regulation establishes principles and procedural rules relative to the transfer of land from its assigned category to another category. The transfer is carried out by district executive committees and the Cabinet in accordance with the Land Code. The Regulations sets out the conditions under which transfer of irrigated land, arable land, plantations, etc. into another (specified) category may take place. Applications shall be made to the commissions of the district executive committees. Decisions are taken by various district or regional authorities.

The State Committee on land Reform shall present the concept of the realisation of land reform to the Cabinet of Ministers. This Committee shall collaborate with series of central and local authorities and non-governmental entities in carrying out measures of land reform regarding special funds, payment for land, ertc. Executive committees on regional, municipal and district level shall work out specific measures for the transfer of agricultural land currently used by citizens, cooperatives, farms, etc.

The State grants land to natural or legal persons who then enjoy the right of ownership and all other accompanying rights envisaged by this Law. The sale and purchase of land is prohibited. Agricultural land is given in ownership or for use to local legal or natural persons without remuneration. Article 4 concerns land tenure by foreigners. Article 5 provides for succession of land rights by members of agricultural cooperatives.
