Council Regulation (EC) No. 1017/94 concerning the conversion of land currently under arable crops to extensive livestock farming in Portugal.

Portugal is hereby authorized for a period of eight years to carry out in the regions referred to in the Annex attached a programme for the conversion of land currently under arable crops to extensive livestock production, up to a maximum of 200 000 hectares. To this end, Portugal shall be allotted a specific autonomous national reserve. Further provisions describe the procedure for obtaining premium rights.

This Regulation extends up to eleven years the period during which Portugal shall be authorized to carry out in certain regions the conversion of land currently under arable crops to extensive livestock production. At the end of the 11 year following the entry into force of this Regulation, unallocated premium rights shall lapse and the specific reserve shall be abolished.

The conditions and method of use and parcelling out of lands, and building must be determined by urban development plans and by local building regulations. In case of existence of a right of pre-emption on an arable land or farm, the proprietor must notice the offer to buy, before the stipulation of the contract, to the persons entitled to pre-emption or privileged lease. The Decree contains detailed rules regarding the way of notification and acceptance or renouncement of the entitled person to pre-emption or privileged lease.

The Regulation provides for the protection of the economical integrity of agricultural enterprises, and their sustainability by preventing land fragmentation due to inheritance proceedings. A three-member commission shall assess the economic status of any agricultural enterprise in the provinces. The implementation procedure shall follow the criteria issued in the Implementation Regulation. The minimum size ceiling required for the partition of agricultural lands is listed in the Regulation. Enterprises engaged in mushroom production, livestock breeding and fisheries could not be divided.

The Ordinance refers to a Bangladesh custom of leasing land, called barga, and to the tenant of that lease, the bargadar, who is an individual tending the land whose property belongs to a different owner. It states that cultivating land belonging to another person and sharing the resulting production is consented only under a barga contract.

This Ordinance rules that land that has not been cultivated for at least two years shall be reclaimed by the Collector for a period not longer than one year from the initial declaration of acquisition, who can lease it to anybody for cultivating crops (food crops as per art. 2, clause ii). If the owner of the reclaimed land wants it back, he must notify his decision to the Collector no later than three months before the one-year expiration date, including the deposit of 50 TK/acre.

The Act provides for land allotment to evacuees, land to be used for agricultural production, pasture, house-building: it entitles the evacuee to the right of using the allotted land and, in those cases when allotments were not conceded prior to the issuing of the present Act, it provides for granting them in those cases when claims are compliant with the law.
