This Chapter provides for the registration of titles in land, defines effect of registration and regulates various other matters relative to registration of title and ownership of real property such as the examination of title. This Chapter makes provision with respect to unlawful transfers of real property in case of fraudulent transactions. Every instrument, other than a will, affecting an estate in real property, including every charge upon real property, or upon its rents or profits, made with intent to defraud prior or subsequent purchasers thereof, or encumbrancers thereon is void as against every purchaser or encumbrancer, for value, of the same property, or the rents or profits thereof.

The present Regulation establishes the modalities of issue and cancellation of special permits for removal and transfer of the fertile soil layer of the plots of land. The provisions of the Regulation establish the modalities of application for obtaining special permit for removal and transfer of the fertile soil layer of the plots of land that are compulsory for land users whose activity is related to the disturbance of the upper (fertile) soil layer.

This Act concerns the ownership of so-called “inner banks”. Section 2 makes provision for the definition of boundaries in original grants of land made by the British South Africa Company.
