Uses and Trusts – Chapter 13 of 21 GCA “Real Property”.

This Chapter provides for various matters relative to trusts in real property. Trusts shall be in writing in accordance with section 1. Sections 2 and 3 concern the protection of the purchaser of a trust. Section 4 concerns a trust given as security. Other provisions of this Act concern conveyancing of trusts and other dispositions regarding trusts and their legal effects.

Part 1 of the Rules makes provisions about the form and arrangement of the register to be kept under the Land Registration Act 2002. Part 2 makes provision about the indices to be kept under the Act. Part 3 makes provisions about applications to the registrar and objections to them; Part 4 deals with applications for first registration of land. Part 5 of the Rules makes provisions about cautions against first registration. Part 6 makes further provisions about applications to the registrar, dispositions of registered land, and the making of miscellaneous entries in the register.

These Rules amend the Land Registration Rules 2003. Rule 1 provides for citation and commencement and rule 2 for interpretation. Rule 3 makes a consequential amendment to rule 91(1) of the principal rules, arising from rule 4. Rule 4 adds a new rule, rule 91A to the principal rules. This allows a number of standard forms of restriction to refer to dispositions of a specified part of the registered estate. It also allows changes in other standard. Rules 5 and 8 amend rules 92(2) and 198(2)(d) of the principal rules respectively. Other changes concern standard forms and registration.

These Regulations specify conditions and procedures for the sale of rural land by an owner of any such land, other than the State, a local authority or a statutory body. An owner shall not sell the land unless he or she has offered to sell it to the Minister and the Minister has issued the owner with a certificate of no interest or hasn’t responded within a given period of time to the offer. The same rules apply to shares of a company owning rural land. Any transfer of land or shares effected in contravention of these Regulations shall be void.

This Act establishes the National Heritage Fund as a body corporate, defines its functions and provides for its internal organization. The principal object of the Fund shall be to safeguard, manage and promote the national heritage of Mauritius. The Fund shall be administered and managed by the National Heritage Trust Fund Board. The principal functions of the Board shall be to identify sites and to manage national heritage entrusted to it.

These Regulations place size limits on rural land in ownership. Rural land is basically land other than urban land, communal land or land owned by the State, a statutory body or a local authority. This Act provides for the management of land and natural resources in the county of Finnmark. This shall be done in a balanced and ecologically sustainable manner for the benefit of the residents of the county and particularly as so as to enhance Sami culture, reindeer husbandry, use of non-cultivated areas, commercial activity and social life. The Act shall apply to real property and watercourses with natural resources in the county of Finnmark. On the shoreline, the Act shall apply as far out to sea as private right of ownership extends.
