This Resolution amends article 1 of Resolution No. 43 of 2003 as follows: “allowing non Bahraini citizens, whether physical person or juridical person, to appropriate land and houses in zones A, B and C of the Kingdom as well as to appropriate tourist and investment projects after the approval of the Ministerial Committee for Public Facilities”.

The aim of this Resolution is to regulate the appropriation of lands by foreigners. The present Resolution is composed of 5 articles. Article 1 defines the zones and areas in which foreigners (physical or juridical persons) can appropriate lands in the Kingdom of Bahrain. Articles 2 and 3 specify the conditions and requirements for the appropriation of lands by foreigners.

The present Regulation implements the Farm Lands Ownership Act. Section 2 establishes that where an application is made to the Board for an exemption from any provision of the Farm Lands Ownership Act, the Board may give favourable consideration to applicants or to acquisitions of land that meet the guidelines listed in this section. With a view to ensure purposeful and efficient land use, and also for the development of housing and mortgage market, the President decrees to authorize privatization by legal persons of land plots on which buildings and constructions are located from 1 January 2007. Long-term lease contracts applicable to the plots of land that have not been privatized in accordance with the above-mentioned modalities shall be subject to re-registration. Natural persons shall be authorized to privatize land plots allocated thereto for individual housing construction from 1 January 2008.

This Ministerial Decree regulates registration of agricultural land of the members of cooperative classified as loan capital and other land owned by the members of cooperative. Agricultural land classified as loan stock shall include agricultural land except for land stock constituting authorized capital stock. Cooperative shall be liable to its members for the use of loan capital for agricultural purposes. Cadastre map of the inhabited area shall be integral part of the register of cooperative land.

Ministerial Decree No. 977 on registration of peasant farms.

This Ministerial Decree regulates keeping of the Register of peasant farms and the modalities of registration thereof. The Register shall be public and it shall contain data related to the establishment re-organization. The scope of the Register shall be to collect and store data and information related to the functioning of peasant farms. The Register shall be kept in the official language but its contents can be translated in other languages. Data regarding land area must be recorded up to a hundredth of hectare.

This Act provides the registration of titles and the appointment of the Registrar of Titles and contains various rules relative to title in land and other rights and interests in respect of land, transfer of titles, etc.The Governor-General shall appoint a Registrar of Titles, Deputy Registrars of Titles and a Panel of Referees of Titles. The Act provides for the lodging of caveats with the Registrar of Titles by persons claiming an interest in land forbidding the bringing of land under the working of this Act.
