This Act sets out the procedures for the acquisition of land by the State for public purposes. The Minister may, by Statutory Instrument, make a declaration to the effect that specified land is required by the Government for a public purpose. Appeal may be had against an award of compensation made by an assessment officer. The Act also provides for temporary occupation of waste or arable land for public purpose.

The present Regulation enacts the Land Transfer Tax Act. The Regulation lays down provisions relating to land lease. Section 1 establishes that where an instrument containing an extension or notice of extension of the rights under a lease or sublease is registered at a time when the term of such lease or sublease including any renewals or extensions, but without regard to the extension to be registered, exceeds fifty years, the value of the consideration in respect to such extension shall be reduced. The text consists of 3 sections.

Land Titles Clarification Act (R.S.N.S. 1989, c. 250).

The present Act lays down provisions relating to the clarification of land titles. Part I deals with land titles clarification areas. Section 3 establishes that where the residents of an area of a municipality are in necessitous circumstances as a result of lack of property development in the area and where there appears to be confusion as to the ownership of land, the Governor in Council may designate the area as a land titles clarification area.

This Order establishes that in case of allotment of a plot of land in ownership or tenancy documents of entitlement for the land plot shall be: (a) land ownership certificate; (b) open-ended land tenancy certificate; (c) provisional land tenancy certificate or lease contract; and (d) private land ownership certificate. Private land ownership certificate shall be issued to natural and legal persons that have been allotted in ownership smallholding, land plots for housing construction, including plots of state and municipal land purchased through tenders.

This Act applies for an SMBI application and an SMBI request, about development that would not have required a development permit under a superseded planning scheme but requires a development permit under the Redland’s IPA planning scheme and in relation to a class 1 building on prescribed land made by or on behalf of the owner of the prescribed land within 10 years after the day the Redland’s IPA planning scheme has effect and for which the person making the request states the owner wishes this Act to apply.

Landholding Control Act (Cap. 8.02)

This Act concerns control of holding of interests in land in Montserrat by foreigners, i.e. a person other than a person who is deemed to belong to Montserrat under the provisions of section 2(2)(b) of the Immigration Act. The Act also provides for forfeiture of land and mortgages held by persons not belonging to Montserrat after commencement of the Act.

This Act concerns adjudication procedures and registration of rights and interests in land in areas as defined by Order of the Governor. The Adjudication Officer shall be in charge of the adjudication. The Adjudication Area shall be divided by this public officer in into two or more adjudication sections. Except with the consent in writing of the Adjudication Officer, no action concerning land or rights to land in an adjudication section shall be begun in any civil court until proceedings under this Act have been completed.
