La historia de un concepto a veces descubre representaciones mentales y expresiones particulares que revelan desarrollos teóricos distintos. Aunque el análisis económico de los derechos de propiedad fue iniciado a comienzos de los años sesenta por Alchian, Coase y Demsetz, el concepto era conocido para los economistas clásicos. En su sentido amplio, la definición de derechos de propiedad estaba presente en las Lecturas sobre jurisprudencia de Adam Smith. Evolucionó notablemente con Ricardo, Senior y J. S. Mill.

Se analiza el efecto de las instituciones en las decisiones de conservación de recursos naturales de los productores agropecuarios en la región montañosa de Nariño. El análisis se basa en las características del sistema de propiedad: derecho de exclusión, seguridad y capacidad de ser transado. A pesar de que la teoría considera a la propiedad privada como la que mayores incentivos genera para la conservación, los resultados del análisis demuestran que esto no siempre es cierto y que otros factores, como los demográficos y tecnológicos, fueron determinantes de las decisiones.

El presente trabajo se propuso determinar, si el procedimiento de prescripción adquisitiva administrativa sobre predios rústicos establecido en el Decreto Supremo 032-2008-VIVIENDA (Reglamento del Decreto Legislativo 1089), viola o no el derecho de defensa de los propietarios involucrados. Todo ello, ante la reforma introducida a la legislación de prescripción adquisitiva sobre predios rústicos regulado por el Decreto Legislativo 667.

La distinción entre el derecho a la propiedad y el derecho de propiedad importa tanto en lo dogmático constitucional como en lo constitucional procesal, en la medida en que las garantías instituidas se activen suficientemente para proteger su oportuno ejercicio. This paper examines the effect of climate change on pastoralist conflict in Africa. The rangelands of East Africa is particularly vulnerable to drought, which is associated with climate change. In this respect, the paper focuses its analysis on changes in resource availability contrasting cases of abundance and scarcity. The authors clarify that the role of resources is further contextualised by competing notions of property rights, and the role of the state in defining property and associated rights.

This paper constructs a framework for and reviews studies on property rights reforms in the agricultural and natural resources sector. In the case of agrarian reform, several hypotheses are posited: that agrarian reform will increase the rate of capital accumulation of beneficiaries and improve tenurial security, but may have negative impacts on land access, investments of landowners, and efficiency of land use. For the natural resources sector, the implications of open access and promotion of property rights are surveyed for the Philippine case.

This study assesses the determinants of forest land allocation to households in the forest tenure reforms in China in the period 1980-2005 using data from three provinces in Southern China; Fujian, Jiang Xi and Yunnan. Furthermore, it assesses the current level of tenure security on forest land and how this tenure security is affected by past and more recent policy changes.
