Towns Nuisance Prevention Act.

This Act introduces measures to prevent nuisances in parishes. The Parish Council shall have powers to abate any imminently dangerous nuisances and may declare land to be a public nuisance. If the land in question is not cleaned, the Council may petition to court to have the land sold. The court may issue a condition order for sale. This order initiates to the procedure for sale of the land. The court may also order cleaning of the land. The Act also concerns properties on the seashore.

This Order provides for drainage in Northern Ireland and defines functions of the Minister and the Drainage Council of Northern Ireland. The Minister may establish drainage schemes for the benefit of watercourses and sea defences. For the purpose of this Order, the Minister may acquire land, either by agreement or compulsorily. The Order also defines duties of occupiers in respect of drainage works and provides for, among other things, drainage schemes extending outside Northern Ireland, removal of noxious weeds, protection of watercourses and control of dams and sluices.

Section 2 allows the Minister to grant leases on the foreshore in the public interest. "Foreshore" means the bed and shore, below the line of high water of ordinary or medium tides, of the sea and of every tidal river and tidal estuary and of every channel, creek and bay of the sea or of any such river or estuary. Every lease shall contain prescribed clauses or covenants as listed in section 2.

This Act vests the ownership of the foreshore and sea-bed in the Crown, subject to the public rights of: (a) navigation and fishing, and (b) of passing over the foreshore, and to any private rights that may exist in or over the foreshore or the sea-bed. The Minister may by notice, after consultation with landowners, designate a foreshore of an island or islet or any part thereof. No person shall remove from a designated foreshore any sand, gravel, reef mud, coral, rock or other like substance without first having obtained from the Chief Lands Officer a licence for that purpose.

It shall not be lawful for any person to dig, take or carry away for building or construction purposes or for providing ballast for a vessel any sand, stone, gravel, etc. from any beach, seashore or floor or to move such materials along a public road., except under and in accordance with a license from the Director of Public works. A permit shall be in the form as set out in the Schedule. No transport of such materials shall take place at night. Transgression of prohibition may comport arrest and seizure of boats, conveyances, or animals used.

This Act concerns the classification, declaration, construction, maintenance and control of public roads and some related matters such as the restriction on the discharge of water and other liquids from private lands onto public roads, the duty of owners of adjoining land in relation with vegetation, restriction on the removal of sand from coastal areas in the vicinity of public roads and the (compulsory) acquisition of land by the Minister and exchange of land for purposes of this Act.

Pas Geometriques Act.

This Act declares areas along the coast known as Pas Geometrique to be public domain and makes provision for the survey of lands in such kind of land areas, the grant of leases, rights of lessees, and prohibits dumping on Pas Geometriques. The Minister may grant leases of Pas Geometriques or annexes. The granting shall take place by private contract or public auction. A clause, which imposes the planting of trees on the lessee, shall be included in every lease contract. Cutting of trees on Pas Geometriques requires permission by the Minister and shall be included in the lease contract.

The present Act provides for the restriction on removal of sand. No person shall remove or carry away from any beach or sea shore or from any land or place, whether publicly or privately owned, any sand without a permit by the Director of Public Works. Section 7 establishes the penalties to be applied in case of contravention.
