The Minister may prescribe different rates with respect to different categories of owners or different categories of agricultural land, differentiating on the basis of any one or more of the following: (i) nationality or residence of owner; (ii) size of agricultural land; (iii) the number of farms owned by the same owner; (iv) activities carried on or predominantly carried on agricultural land, whether farming operations or otherwise, by an owner or any person having the right of occupation and use of agricultural land through the owner thereof; or (v) any other basis which the Minister may

This Regional Law regulates relations on land tenure and protection of land. Regional Legislative assembly shall have the following competence in the sphere of land protection: (a) reserve land, also through buyout of land plots, for public and municipal needs; (b) proclamation of protected areas; (c) establishment of minimum and maximum dimensions of land plots of public land allotted for agricultural purposes, farming, horticulture and stockbreeding; (d) establishment of cases of gratuitous allotment of public and municipal land to natural and legal persons (art. 2).

This Act provides for further definitions of certain expressions and various amendments concerning functions and powers and organizational structure of the Land Reform Advisory Commission of the Agricultural (Commercial) Land Reform Act, 1995. The definition in section 1 of "alienate" in relation to agricultural land is modified. various amendments concern functions and powers and organizational structure of the Land Reform Advisory Commission. In section 17 a new subsection 5(a) is inserted. This provision concerns the withdrawal of an offer to sell land to the State.

The Law lays down the criteria and the rules of procedure required for granting ownership without compensation of agricultural land of former agricultural enterprises to beneficiaries specified by Law No. 8053. It establishes 30 June 2016 as the deadline for terminating all transfer procedures.

The Decree provides the regulation for redistribution of abandoned, denuded, mountainous lands or uncultivated lands to households and families in order to increase their agricultural productions. Households and families shall be assigned with those lands the right to use them and cultivate them.

According to article 91a, paragraph 1, of the German Constitution (Grundgesetz) measures on the improvement of production methods, working conditions, management and in general in the agricultural, fishery, forestry and water sector shall be taken with the agreement of regional governments. For this purpose a common frame work is devised and every year within the 1 March the Länder submit a general working plan to the Federal Minister for Nutrition, Agriculture and Forestry for approvement within the said frame work.
