The present Act lays down provisions relating to the taxation of land in Austria. Article 1 establishes that domestic real property is subject to property tax. Domestic real property is, inter alia, agricultural and forestry land and agricultural and forestry enterprises. Article 2 lists cases for which no land tax has to be paid. The text consists of 33 articles divided into 4 Parts as follows: Tax obligation (I); Calculation of land tax (II); Payment of land tax (III); Final and transitional provisions (IV).

In section 2 the definition of "base date" is added. A date base in relation to valuation roll for a district means the date when the revision of valuation roll for that district comes into force. Section 12 is amended so as to empower the Minister responsible for lands to appoint various base dates for purposes of enabling the Chief Valuer to revise valuation rolls as provided for in section 13. Section 18 is amended so as to provide for certificates, which shall be obtained prior to transactions involving lands, are to take place.

The Decree, composed of 4 articles, declares of social interest, for the purposes of the expropriation for the Union, some properties and related rights and benefits. This expropriation is considered necessary for the implementation of the first stage of the Project for the Integration of the River São Francisco with the Northeast River Basins in the States of Pernambuco, Ceará and Paraíba. This Order establishes additional provisions related to the Farms Act. A farm/land property can be registered as such and notification thereof shall be submitted to the Survey and Cadastre Authorities to ensure proper residency status. When establishing a new farm, or purchasing additional land, a 10-year residence proof is required by the purchaser within 6 months from the date the Survey and Cadastre Authorities have registered the cadastral changes. Provisions also include companies in other EU countries or countries that have signed the Agreement on the European Economic Area (EEA).
