Le présent décret fixe les modalités d’application de la loi n°60-004 du 15 février 1960 relative au domaine privé national. Le service des domaines est chargé de gérer les biens appartenant à l’Etat ainsi que ceux qu’il détient sous l’expectative d’une appropriation définitive à l’expiration d’un certain délai. Cette gestion s’applique également à tous les biens sur lesquels l’Etat exerce un pouvoir d’attribution ou de surveillance, tels que les biens des contumax.

Les fonctionnaires des cadres de l’Etat, les agents auxiliaires de l’Etat, des provinces, des communes, les agents permanents des établissements publics, les officiers et les sous officiers des forces armées peuvent acquérir librement des propriétés privées, en les achetant, soit de gré à gré, soit à des ventes aux enchères publiques.

The present Ordinance lays down provisions relating to the conversion of lease into property in agricultural enterprises. Article 1 establishes the necessary conditions for such a conversion and in particular that the lease will have lasted for not less than six years. The text consists of 4 articles.

The aim of this Resolution is to regulate the registration of land. This Resolution is composed of 2 Sections divided into 6 articles. Section I deals with survey procedures in particular: (a) competencies and duties of the Survey Department; (b) competencies and duties of surveyors; (c) survey registration and fees; (d) modification or correction of survey maps; and (e) measuring operations. Section II pertains to land maps and ownership documents.

The aim of this Implementing Regulation is to regulate land registration. This Regulation is composed of 4 Sections divided into 44 articles. Section I deals with land ownership, maps, documents and data including information related to wells, palms and other cultivated plants. Section II refers to the legal procedures and administrative steps necessary for land registration. Section III provides for ownership documents. Section IV pertains to land division and expropriation.

The present Regulation implements the Farm Lands Ownership Act. Section 2 establishes that where an application is made to the Board for an exemption from any provision of the Farm Lands Ownership Act, the Board may give favourable consideration to applicants or to acquisitions of land that meet the guidelines listed in this section. This Ordinance, consisting of five Parts, applies to Tamils in property matters. It specifies that movable or immovable property a woman acquires during or before marriage remains her separate property. A woman has the power to deal with her movable property during her lifetime without the consent of her husband. However, a married woman may deal with or dispose of any immovable property to which she is entitled only with the written consent of her husband, except in the case of last wills.

This Resolution consists of 4 Chapters divided into 27 articles: Appropriation circumstances (I); Appropriation arrangements and administrative arrangements (II); Estimation Committee (III); General provisions (IV). Ministries, Authorities, Departments and Public Establishments can appropriate Real Estate and land for public benefit according to this Law (art. 1). Article 4 deals with the appropriation by mutual consent. Legal appropriation is dealt with in articles 5-9. The temporary confiscation of land is provided for in articles 10-13.
